International law is fragmented and complex, and at the same time increasingly capable of shaping reality in areas as diverse as human rights, trade and investment, and environmental law. The increased influences of international law and its growing institutionalization and judicialization invites reconsideration of the question how should the authority to make and interpret international law be allocated among states, international organizations and tribunals, or in other words, "who should decide what" in a system that formally lacks a central authority? This is not only a juridical question, but one that lies at the very heart of the political legitimacy of international law as a system of governance, defining the relationship between those who create the law and those who are governed by it in a globalizing world. In this book, leading international legal scholars address a broad range of theoretical and practical aspects of the question of allocation of authority in international law and debate the feasibility of three alternative paradigms for international organization: Sovereignty, Supremacy and Subsidiarity. The various contributions transcend technical solutions to what is in essence a problem of international constitutional dimensions. They deal, inter alia, with the structure of the international legal system and the tenacity of sovereignty as one of its foundations, assess the role of supremacy in inter-judicial relations, and draw lessons from the experience of the European Union in applying the principle of subsidiarity. Yet, as the Cold War ended and the Soviet Union dissolved, each of these organizations evolved to have a post-Cold War role in the region. This book examines the development of cooperation between the EU and NATO, two key non-state actors in the European security architecture. The work examines the relationship between the EU and NATO by focusing on the perspective of member states. Highlighting the relevance of member states’ role in shaping EU-NATO relations, it conceptualises interorganisational cooperation and develops a typology of member states based on four types: advocates, blockers, balancers and neutrals. To apply this typology and analyse member states’ specific roles, the analysis considers their foreign and security policy orientations, bilateral relationships with other member states, and contributions to both military operations, and division of labour between the two organisations. The book also examines states’ use of political strategies -- such as forum-shopping, hostage-taking and brokering -- that influence the design, evolution and practicalities of cooperation between the EU and NATO. This book takes up one of the key theoretical challenges in the English School’s conceptual framework, namely the nature of the institutions of international society. It theorizes their nature through an analysis of the relationship of primary and secondary levels of institutional formation, so far largely ignored in English School theorizing, and provides case studies to illuminate the theory. Hitherto, the School has largely failed to study secondary institutions such as international organizations and regimes as autonomous objects of analysis, seeing them as mere materializations of primary institutions. Building on legal and constructivist arguments about the constitutive character of institutions, it demonstrates how primary institutions frame secondary organizations and regimes, but also how secondary institutions construct agencies with capacities that impinge upon and can change primary institutions. Based on legal and constructivist ideas, it develops a theoretical model that sees primary and secondary institutions as shared understandings enmeshed in observable historical processes of constitution, reproduction and regulation.
