Fononann DETAINER--'Will not lie to recover personal property.---Where a lessor of a lot upon which the lessee had built a house, levied a distress warrant upon the house and purchased it at the sale, it was held that forcible detainer would not lie to get possession of the house, as that action lies only to recover real property. If the house was to be treated as real property the proceedings in distress could not confer any title to it. It would be presumed to be a part of the realty, and so not liable to distraint. There being no evidence to show a termination of the tenancy, the judgment for possession was erroneous. Excerpt from The Columbia Jurist, Vol. 1: A Weekly Law Journal; February 3rd, 1885, to June 10th, 1885 I am unable to see, says Judge Brown, the distinction between a con tract which a married woman enters into with her husband, under which he man ages her separate estate or business as her agent, and a contract of partnership, which is nothing more than a mutual agency by each in reference to the common business of both. This decision would 'seem to maintain more definitely than any case that we at present call to mind, the opinion of the court in Better 12. Bathman, 61 N. Y. 512, in which the Court says: If the wife has the capacity to contract with the husband with reference to her separate estate, there is no limit upon the power in the statute.
