This book examines the development of the theory and practice of constitutionalism, defined as a political system in which the coercive power of the state is controlled through a pluralistic distribution of political power. It explores the main venues of constitutional practice in ancient Athens, Republican Rome, Renaissance Venice, the Dutch Republic, seventeenth-century England, and eighteenth-century America. From its beginning in Polybius' interpretation of the classical concept of mixed government, the author traces the theory of constitutionalism through its late medieval appearance in the Conciliar Movement of church reform and in the Huguenot defense of minority rights. After noting its suppression with the emergence of the nation-state and the Bodinian doctrine of sovereignty, the author describes how constitutionalism was revived in the English conflict between king and Parliament in the early Stuart era, and how it has developed since then into the modern concept of constitutional democracy.
Ancient Greeks and Romans often wrote that the best form of government consists of a mixture of monarchy, aristocracy, and democracy. Political writers in the early modern period applied this idea to government in England, Venice, and Florence, and Americans used it in designing their constitution. In this history of political thought James Blythe investigates what happened to the concept of mixed constitution during the Middle Ages, when the work of the Greek historian Polybius, the source of many of the formal elements of early modern theory, was unknown in Latin. Although it is generally argued that Renaissance and early modern theories of mixed constitution derived from the revival of classical Polybian models, Blythe demonstrates the pervasiveness of such ideas in high and late medieval thought. The author traces medieval Aristotelian theories concerning the best form of government and concludes that most endorsed a limited monarchy sharing many features with the mixed constitution. He also shows that the major early modern ideas of mixed constitutionalism stemmed from medieval and Aristotelian thought, which partially explains the enthusiastic reception of Polybius in the sixteenth century. This book deals with the ways in which medieval and early modern historians, lawyers and politicians deployed their own national history to justify opposition to the English kingship. More particularly, it is a study of the origins and development of an historical construct called the 'radical ancient constitution', a version of the past which originated from sources including the so-called 'Laws' of Edward the Confessor. The book tells how a cult of kingship, centred around the Confessor's 'Laws', was transformed from a cult that sacralized the upstart Norman dynasty into one which desecrated the Stuart monarchy. In telling the story of the 'ancient constitution' the author reconfigures the historical landscape of early modern England and demonstrates that the so-called Whig version of history, far from being a concoction of seventeenth-century dissidents, enjoyed the sanction of medieval and early modern historians, scholars and lawyers.
