This book brings a fresh perspective on the emerging field of international food law with the first detailed analysis of the process and implications of domestic compliance with the World Trade Organisation (WTO) Sanitary and Phytosanitary (SPS) Agreement. It investigates the influence of WTO disciplines on the domestic policy-making process and examines the extent to which international trade law determines European Union (EU) food regulations. Following controversial WTO rulings on genetically-modified foods and growth hormones in beef, awareness and criticism of global rules governing food has grown considerably. Yet the real impact of this international legal meta-framework on domestic regulations has remained obscure to practitioners and largely unexplored by legal commentators. Trade agreements have become politicized in part because of public concerns that trade rules constrain regulatory decisions. How much international obligations constrain state behaviour, however, is contested in the International Relations literature. This book seeks to explain whether, why, and how jurisdictions comply with inconvenient international obligations. It does so through detailed process tracing of European Union (EU) policies found incompatible with World Trade Organization (WTO) rules: its ban on hormone-treated beef, its banana trade regime, its moratorium on the approval of genetically modified crops, its sugar export subsidies, and its anti-dumping duties on bed linen from India. It uses the adverse rulings as the 'treatment' in a 'natural experiment', contrasting the policy-relevant politics before and after each ruling. The case studies are supplemented by a qualitative comparative analysis of all EU policies found to contravene WTO rules that had to be changed by the end of 2019. The book contributes to debates on the impact of international institutions, on the effectiveness of the WTO, and on the nature of the EU as an international actor. It argues that the preferences of policy makers (the 'supply' of policy change) matter more than demands from societal actors in determining whether compliance occurs. It also argues that while policy change in response to adverse WTO rulings is the norm (good news for trade), WTO members do resist obligations that would compromise cherished policy objectives (good news for legitimacy). This volume contends that the EU's compliance performance is like that of most WTO members; it is not a unique international actor.

This book examines the construction of the EU’s political identity (or identities), variations in its strength, and the nature of its content. Drawing on studies both on European nation-state formation and on the EU’s identity, the chapters take a top-down approach and analyse how EU institutions in different major policy domains have themselves sought to create political identity through policy making. The authors define the construction of EU political identity and set out empirically applicable indicators to assess political identity in policy making. They analyse the construction of identity through a process-oriented approach that explicitly includes contestation and the existence of rival political identities. Comparing across policy domains, the contributions suggest that the ability of EU institutions to construct an EU political identity has been limited not only by existing national identities but also by the coexistence of rival EU political identities within policy domains. Hence, it has been difficult for EU institutions to establish a strong identity, with identity being strongest where there are clear external alternatives and limited rival identities within the EU.
