La obra que tiene en sus manos el lector es producto de un juicioso trabajo de investigación y -no sobra decirlo- de reflexión de su autora, quien desde muy temprano se destacó en las aulas de estudio por su acuciosidad, sentido crítico y disposición al diálogo constructivo. Tuve el gusto de acompañar a Deisy Villalobos, en calidad de directora de tesis, durante la concepción y construcción de este documento, que en su momento fungió como requisito para su grado profesional de abogada, y que hoy se le entrega a la comunidad estudiantil ya la Academia en general con el fin de contribuir al debate sobre la posible aplicación de la teoría anglosajona del incumplimiento eficiente en materia contractual. La obra se encuentra dividida en cuatro capítulos. El primero de ellos, que lleva por título "La 'teoría del incumplimiento eficiente' como reivindicación de los criterios económicos dentro de los esquemas modernos de derecho contractual", se ocupa de estudiar el origen y la evolución que ha experimentado la teoría del incumplimiento eficiente del contrato en los sistemas pertenecientes al sistema de Common Lato, para luego determinar su posible compatibilidad con los ordenamientos jurídicos de tradición civilista como el colombiano. En el segundo capítulo, cuyo título es "La incidencia de los incentivos económicos dentro del comportamiento negocial de los agentes del mercado. La armonización razonable entre los criterios económicos y los dogmas clásicos del derecho contractual", la autora se ocupa de identificar los retos que el derecho contractual asume de cara a la actual dinámica negocial, en la que se evidencia la reivindicación de los principios económicos, al constituirse como guías o móviles que determinan las conductas contractuales de los agentes del mercado, y crean con ello la necesidad de un reconocimiento razonable de los principios económicos dentro de las instituciones jurídicas +en particular, dentro del derecho de los contratos. De esta manera, se deja en evidencia que la dinámica actual de la contratación moderna exige la armonización razonable y lógica de la dogmática jurídica de la noción del contrato y una visión jurídico-económica más realista, que contemple la función que el mecanismo negocial tiene dentro del mercado "como un instrumento de dinamismo en los negocios por oposición a una aproximación tradicionalmente estática"; sin que ello implique reducirlo a un instrumento de maximización de recursos, y menos aún a una simple técnica de ejecución de obligaciones, o dejar de lado las finalidades éticas, sociales y jurídicas que por antonomasia persigue el mecanismo negocial.

This report considers the biological and behavioral mechanisms that may underlie the pathogenicity of tobacco smoke. Many Surgeon General's reports have considered research findings on mechanisms in assessing the biological plausibility of associations observed in epidemiologic studies. Mechanisms of disease are important because they may provide plausibility, which is one of the guideline criteria for assessing evidence on causation. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
