The "sobbing" vocal quality in many traditional songs of northwestern California Indian tribes inspired the title of Richard Keeling's comprehensive study. Little has been known about the music of aboriginal Californians, and Cry for Luck will be welcomed by those who see the interpretation of music as a key to understanding other aspects of Native American religion and culture. Among the Yurok, Hupa, and Karok peoples, medicine songs and spoken formulas were applied to a range of activities from hunting deer to curing an upset stomach or gaining power over an uninterested member of the opposite sex. Keeling inventories 216 specific forms of "medicine" and explains the cosmological beliefs on which they were founded. This music is a living tradition, and many of the public dances he describes are still performed today. The Native American Graves Protection and Repatriation Act (NAGPRA) of 1990 provides a legal framework within which Native Americans can seek the repatriation of human remains and certain categories of cultural objects--including "sacred objects"--from federally funded institutions. Although the repatriation movement among Native Americans has heretofore received scholarly attention specifically focused on this act, Sacred Claims is the first book to analyze the ways in which religious discourse is used to articulate repatriation claims. Greg Johnson takes this act as one instance in a larger context wherein native peoples around the globe must engage legal arenas in order to preserve their heritage. Methodologically, Sacred Claims is based on a close reading of government documents concerning the law and participant observation in a variety of NAGPRA-related events and provides the background and legislative history of the law, the life history of the act's axial term cultural affiliation (the most delicate and least understood aspect of NAGPRA), and several case studies of highly visible and contentious Hawaiian repatriation disputes. Johnson then moves beyond the strictly legal context to analyze NAGPRA discourse in the public realm. He concludes by way of a theoretical treatment of the foregoing issues, arguing that religious language was the chief means by which native representatives ultimately persuaded non-native audiences of the applicability of widely-held human rights principles to their cultural remains. Theorizing modes of cultural vitality in the repatriation context, Johnson argues that living tradition is not found in the objects themselves but is instead located in struggles over them. With the law on the brink of receiving crucial tests, and repatriation issues making daily headlines in Native American and Hawaiian news, Sacred Claims is a timely and necessary examination of these issues.
"Although blasphemy is as old as religion itself, its history has begun a new chapter in recent years. Slanders of the sacred are everywhere, as in the highly visible Charlie Hebdo case, with "religion" sometimes appearing as little more than a membrane for giving and receiving offense. Where some explain the contemporary preoccupation with blasphemy by pointing to the interconnectedness of twenty-first-century media, J. Barton Scott argues that we need to look deeper into the past at the colonial-era infrastructures that continue to shape our globalized world. Slandering the Sacred examines one such powerful and widely influential legal infrastructure: Section 295A of the Indian Penal Code. What would it look like to take Section 295A as a text in, of, and for religion-a connective tissue interlinking multiple religious worlds? To answer this question, Scott explores the cultural, intellectual, and legal pre-history of this law, moving between colonial India and imperial Britain as well as between secular law and modern religion. Section 295A reveals a set of problems with no easy solution. It places a chill on free speech, extends the power of the state over civil society, and exacerbates the culture of religious controversy that it was designed to fix. The legislators who enacted the law foresaw the damage it could do and they enacted it anyway, as a half-despairing measure to curb injurious speech. Their problems are still our problems. The twenty-first century has compounded modernity's free-speech headache. Section 295A opens a useful window onto these problems precisely because it is a problem, too. Demystifying the Sacred: Blasphemy and Violence from the French Revolution to Today offers a much-needed analysis of a subject that historians have largely ignored, yet that has considerable relevance for today’s world: the powerful connection that exists between offences against the sacred and different forms of violence. Drawing on cases from revolutionary France to the Russia of Vladimir Putin, the international authors probe the nature and agency of local blasphemy accusations, the historical and legal framework in which they were expressed and the violence, both physical and symbolic, accompanying them. In doing so, the volume reveals how cultures of blasphemy, and related acts of heresy, apostasy and sacrilege, were a companion to or acted as a trigger for physical action but also a form of how violence was experienced. More generally, it shows the importance of religious sensibilities in modern society and the violent potential contained in criticism or ridicule of the sacred and secular alike.
In 1988, Lydia Cabrera (1899–1991) published La lengua sagrada de los Ñáñigos, an Abakuá phrasebook that is to this day the largest work available on any African diaspora community in the Americas. In the early 1800s in Cuba, enslaved Africans from the Cross River region of southeastern Nigeria and southwestern Cameroon created Abakuá societies for protection and mutual aid. Abakuá rites reenact mythic legends of the institution’s history in Africa, using dance, chants, drumming, symbolic writing, herbs, domestic animals, and masked performers to represent African ancestors. Criminalized and scorned in the colonial era, Abakuá members were at the same time contributing to the creation of a unique Cuban culture, including rumba music, now considered a national treasure. Translated for the first time into English, Cabrera’s lexicon documents phrases vital to the creation of a specific African-derived identity in Cuba and presents the first “insider’s” view of this African heritage. This text presents thoroughly researched commentaries that link hundreds of entries to the context of mythic rites, skilled ritual performance, and the influence of Abakuá in Cuban society and popular music. Generously illustrated with photographs and drawings, the volume includes a new introduction to Cabrera’s writing as well as appendices that situate this important work in Cuba’s history. With the help of living Abakuá specialists in Cuba and the US, Ivor L. Miller and P.
