This book bridges a scholarly divide between empirical and normative theorizing about procedural justice in the context of relations of power between citizens and the state. Empirical research establishes that people’s understanding of procedural justice is shaped by relational factors. A central premise of this volume is that this research is significant but needs to be complemented by normative theorizing that draws on relational theories of ethics and justice to explain the moral significance of procedures and make normative sense of people’s concerns about relational factors. The chapters in Part 1 provide comprehensive reviews of empirical studies of procedural justice in policing, courts and prisons. Part 2 explores empirical and normative perspectives on procedural justice and legitimacy. Part 3 examines philosophical approaches to procedural justice. Part 4 considers the implications of a relational perspective for the design of procedures in a range of legal contexts. This collection will be of interest to a wide academic readership in philosophy, law, psychology and criminology.
Even for violent crime, justice should mean more than punishment. By paying close attention to the relational harms suffered by victims, this book develops a concept of relational justice for survivors, offenders and community. Relational justice looks beyond traditional rules of legal responsibility to include the social and emotional dimensions of human experience, opening the way for a more compassionate, effective and just response to crime. The book’s chapters follow a journey from victim experiences of violence to community healing from violence. Early chapters examine the relational harms inflicted by the worst wrongs, the moral responsibility of wrongdoers and common mistakes made in judging wrongdoing. Particular attention is paid here to sexual violence. The book then moves to questions of just punishment: proper sentencing by judges, mandatory sentences approved by the public, and the realities of contemporary incarceration, focusing particularly on solitary confinement and sexual violence. In its remaining chapters, the book looks at changes brought by the victims' rights movement and victim needs that current law does not, and perhaps cannot meet. It then addresses possibilities for offender change and challenges for majority America in addressing race discrimination in criminal justice. The book concludes with a look at how individuals might live out the ideals of a greater—relational—justice. This collection examines the power and transformative potential of movements that fight against poverty and inequality. Broadly, poverty politics are struggles to define who is poor, what it means to be poor, what actions might be taken, and who should act. These movements shape the sociocultural and political economic structures that constitute poverty and privilege as material and social relations. Editors Victoria Lawson and Sarah Elwood focus on the politics of insurgent movements against poverty and inequality in seven countries (Argentina, India, Brazil, South Africa, Thailand, Singapore, and the United States). The contributors explore theory and practice in alliance politics, resistance movements, the militarized repression of justice movements, global counterpublics, and political theater. The moral inquiry into the nature of justice is often marginalized, as contemporary discussions focus primarily on political considerations. Yet, the need to examine the moral framework of justice is fundamental. What is the point of justice, after all, if not to establish a moral framework for political interactions? The question resonates especially when recognizing that no monocultures exist over time and space. In examining Plato’s thoughts on individual and social morality (dikaiosune) and Aristotle’s focus on individual virtue (arête) and the pursuit of well-being (eudaimonia), the author proffers foundational resources for today’s discussions of justice. Moreover, he brings this nexus of thought into conversation with theories that have emerged over the centuries, such as Kant’s concept of due concern and respect, individual rights and responsibilities as in Hobbes, Locke and J.S. Mill. Musical activity is one of the most ubiquitous and highly valued forms of social interaction in North America (to say nothing of world over), being engaged from sporting events to political rallies, concerts to churches. Moreover, music's use as an affective agent for political and religious programs suggests that it has ethical significance. Indeed, many have said as much. It is surprising then that music's ethical significance remains one of the most undertheorized aspects of both moral philosophy and music scholarship. Music for Others: Care, Justice, and Relational Ethics in Christian Music fills part of this scholarly gap by focusing on the religious aspects of musical activity, particularly on the practices of Christian communities. Based on ethnomusicological fieldwork at three Protestant churches and a group of seminary students studying in an immersion course at South by Southwest (SXSW), and synthesizing theories of discourse, formation, and care ethics oriented towards restorative justice, it first argues that relationships are ontological for both human beings and musical activity. It further argues that musical meaning and emotion converge in human bodies such that music participates in personal and communal identity construction in affective ways-yet these constructions are not always just. Thus, considering these aspects of music's ways of being in the world, Music for Others finally argues that music is ethical when it preserves people in and restores people to just relationships with each other, and thereby with God.
"Why does equality matter, as a social and political value, and what does it require? Relational egalitarians argue that it does not primarily require that people receive equal distributive shares of some good, but that they relate as equals. This book develops a liberal conception of relational equality, which understands relations of non-domination and egalitarians norms of social status as stringent demands of social justice. First, it argues that expressing respect for the freedom and equality of individuals in social cooperation requires stringent protections against domination; develops a substantive, liberal conception of non-domination; and argues that non-domination is a particularly important, but not the only, concern of social justice. These features set it apart from, and provide it with crucial advantages over, neo-republican accounts of non-domination. Second, the book develops an account of the wrongness of inegalitarian norms of social status, which shows how status-induced foreclosure of important social opportunities is a social injustice in its own right, over and above the role of status inequality in enabling domination, and the threats it poses to individuals' self-respect. Finally, it works out the implications of liberal relational egalitarianism for political, economic, and health justice, showing that it demands, in practice, far-reaching forms of equality in all three domains. In so doing, the book draws on, and brings together, several different literatures: on social justice and liberalism, distributive and relational equality, the distinct value of social equality, and neo-republicanism and non-domination"--
