This new book presents a clear conceptual framework for understanding the transfer of policy ideas between EU states, together with an empirical study of regulatory change within European utilities. Policy transfer is a new instrument for understanding EU policy-making. This volume shows how the nature of institutions, interdependence between trans-national and national jurisdictions and social systems, relate policy actors across geographical boundaries, identifying four basic types of EU policy transfer and learning: ‘uploading’– how member states compete to shape the EU agenda in line with their own institutional arrangements and policy preferences ‘downloading’– how states adapt to changing EU incentives and constraints ‘socialization’ – how EU policy norms are internalized in the belief systems of domestic actors ‘information exchange’ between national actors in the course of EU interactions leading to a horizontal diffusion of policy ideas. The authors use an institutionalist perspective to show how these forms of policy transfer operate across the diverse systems of governance found across the EU. Policy Transfer in European Union Governance will be of great interest to students and scholars of European Union politics and policy, comparative public policy and political economy.
The European Union has developed a wide array of external relations with its neighbouring countries. Without offering full membership, the EU nevertheless attempts to transfer its rules and policies to non-member countries. It is this extension of EU rules beyond EU borders that the analysis of external governance seeks to capture. The contributions to this volume explain the modes and effects of EU external governance in a variety of EU–non-member country relations in Western Europe, the former Soviet Union, and the Mediterranean region. This book investigates the increasing circulation and transfer of public policy ideas between the UK, US and Australia since the 1990s. It argues that the upsurge in policy transfer amongst and between these states can be explained by a structural and shared commitment between these states to a distinctive institutional ideology of policy-making. This ideology, it is claimed, is partly a product of the historical proximity of ‘Anglosphere’ states, and in recent years can be traced through the evolution of New Public Management principles through to Third Way communitarianism.

This book explores how and why the transposition of EU directives in the new and contentious policy area ‘Business and Human Rights’ differs between member states. It reveals the extent to which individual member states are pursuing diverging approaches in dealing with the ‘discretionary space’ in EU directives, and highlights theoretical and political explanations. Drawing on historical institutionalism and rational choice institutionalism, the book establishes a link between the degree of corporatism in a given political economy and government behaviour in terms of Business and Human Rights policy. Moreover, it identifies political salience within the policy subsystem as a pertinent factor for explaining national transposition outcomes.

This book is the result of the PhD project I started four years ago at Europa-Kolleg Hamburg. I had the great opportunity to work on it for one year at the European University Institute in Florence and to finalise the oeuvre during my stay with the European Commission's Institute for Prospective Technological Studies in Seville. The subject matter of the book is intellectual property rights, patents in particular, and their process of harmonisation in Europe. At the beginning of the work, the intention was not to focus immediately on one narrow field in the huge realm of intellectual property rights but rather to open my mind in order to capture a broad variety of new ideas and concepts in the book. The work at three different institutes in three different European countries over the period of four years naturally exposed the work to diverging ideas and the exchange of views with many people. This is one reason for the wide spread of topics ordered around the given leitmotif, such as epistemological foundations, political background information,. the protection of biotechnological inventions and the building up process of intellectual property right systems in the countries of Central and Eastern Europe. In chapter two I take up Polanyi's differentiation of codifiable and tacit knowledge. Applying these concepts to my own work I realise that this book is only the visible and codified part of knowledge I was able to capture.
