This book describes the global legal framework for safeguarding the “Intangible Cultural Heritage” – as defined by the UNESCO Convention in 2003 – and analyses its use in selected countries in the Americas, Asia, Africa and Europe. Each of the contributions has been prepared by high profile experts and strategically addresses countries that are representative for their corresponding area. Our understanding of the term “Cultural Heritage” has changed considerably over the past few decades, and it is becoming increasingly clear that the concept also includes traditions and living expressions that we inherit from our ancestors and pass on to our descendants. UNESCO has recognised and responded to this change of perspective, creating through the 2003 Convention an international instrument for safeguarding the “Intangible Cultural Heritage”, a notion including oral traditions, performing arts, social practices, rituals, festive events, knowledge and practices concerning nature and the universe, as well as the knowledge and skills needed to produce traditional crafts. New values, practices and heritages were recognized – from the ancient African rituals to the Mexican Mariachi musical expression to the Brazilian Samba and the Mediterranean Diet – all of which convey strong social and cultural meaning for their community's identity. Intangible Cultural Heritage is a growing, relatively recent field of study and also an emblem of the dialogue between distant populations with different cultures, which is the reason why a comparative approach is the most appropriate basis for conducting an analysis of how the contracting states to the Convention live up to their commitments through national safeguarding measures and enhancement policies or through international cooperation projects.
This collection provides an in-depth and up-to-date examination of the concept of Intangible Cultural Heritage and the issues surrounding its value to society. This book analyses the topic of protecting traditional cultural expressions (TCEs) in Latin America. It questions classic legal approaches and involves the interface of anthropology and law. The study analyses regional, national and local particularities of law on paper and law in reality. It includes personal fieldwork research in selected countries and puts light on the political, socio-economic and environmental dimension of the topic. Based upon these insights, the study gives recommendations for a more enhanced, interdisciplinary understanding and protection of TCEs. Latin America is (still) rich of cultural traditions and bio- and sociodiversity. This region is the cradle of the international discussion on protecting TCEs. The national situations are diverse and allow conclusive comparisons. Some countries have established concrete protection systems, like Panama, and made useful experiences. It is time to resume: What do TCEs really mean? Should they be protected by law and if so, how? What can we learn from the practical experiences made so far? The following is clear: The true test for any new legislation – in Latin America and elsewhere – is its impact on the everyday life.
Sport History is a growing field of study in Brazil. In the past decades, scholars from different areas have taken an increasing interest in studying how sports help us in understanding broader social, cultural, political and economic aspects of society. Barriers of language have often distanced Brazilian historiography from the international community which makes this volume in English especially important as a contribution to the field. In the last decade, Brazil has been on the spotlight of international sporting events and with the staging of the 2014 FIFA World Cup and the 2016 Olympic Games, in Rio de Janeiro, the world is focused on Brazilian sports, and this book provides a route into understanding it. This book critically analyses the 2003 Convention for the Safeguarding of the Intangible Cultural Heritage, UNESCO's latest and ground-breaking treaty in the area of cultural heritage protection. Intangible cultural heritage is broadly understood as the social processes that inform our living cultures, and our social cohesion and identity as communities and peoples. On the basis of this conception, the Treaty proposes to turn our understanding of how, for whom, and why heritage is safeguarded on its head, by putting communities, groups and individuals at the centre of the safeguarding process. The commentary, written by leading experts in the field from all continents and multiple disciplines, provides an authoritative guide to interpreting and implementing not only this Treaty, but also its ripple effects on how we think about cultural heritage and our experience with it as a part of our living cultures. Patchwork in times of plurality encompasses the multitude of actions as a revealing symbol of ethos, actors, organisms, and manifestations of preservation and dialogue frontiers. This plural metaphor, almost like a patchwork, aggregates and yet segregates, conforms, but disfigures, and boosts the meanings which represent this new field that international relations have been recently crossing. Just like the mirror metaphor - that reflects everything to all and, sometimes, intervenes in distortions - the patchwork analogy allowed the book to take responsibility for the disclosure of preservation actions on a global scale. The book has a pioneering role insofar since it is the only publication with such characteristics, concerns, and coverage. The work studies the interconnection between cultural properties and international relations by understanding them as a mosaic before the bridges that intertwine people and borders. The main goal of this work is to illustrate in what way intergovernmental relations have been privileging heritage and culture as acting fields for its broader needs. Therefore, the book addresses topics related to the international agenda, focusing on its less debated themes. Two examples of these undervalued matters are the link between actors, preservationist actions, and the universe of world cultural heritage. The book also pursuits a critical dialogue between interdisciplinary fields that narrow heritage frontiers in search to contribute with a spectrum of academic perspectives and (inter)national study cases. To serve distinct economic, social, or political purposes, institutionalized heritage (embodied by different values) becomes instrumentalized in a top-down direction. In a development frame, when we perceive culture as indispensable to human life, the past is transformed into exchange currency. Through the creation of alternative fields of action, usually in a bottom-up logic, the present builds new heritage connections. Digital heritage's preservation, dissemination, and appreciation have been representing these same nets.
For nearly 70 years, the United Nations Educational, Scientific and Cultural Organization (UNESCO) has played a crucial role in developing policies and recommendations for dealing with intangible cultural heritage. What has been the effect of such sweeping global policies on those actually affected by them? How connected is UNESCO with what is happening every day, on the ground, in local communities? This Handbook provides a cutting edge study of the fast developing field of international law on the protection of cultural heritage by taking stock of the recent developments and of the core concepts and current challenges. The legal protection of cultural heritage has come under renewed focus from the international community and states since the 1990s. This is evidenced by the adoption of a range of international instruments. Countries are also enacting cultural heritage legislation or overhauling existing laws within their own national territory. Contributions address the protection of immovable and movable, tangible and intangible cultural heritage in peacetime and in the event of armed conflict as well as the interaction between specific regimes of cultural heritage protection with other fields of international law, including international criminal law, human rights and humanitarian law, environmental law, international trade, investments, and intellectual property. The last part of the Handbook covers diverse regional systems of heritage protection.
