This is a study of the history and function of the highest ecclesiastical tribunal, the Sacra Romana Rota, from the twelfth to the sixteenth centuries. Despite its importance for Christendom and in contrast with other important papal offices, the activity of the Rota has never been thoroughly investigated on the basis of archival sources, in large part due to the vast source material and the perceived "difficulty" of the subject. This book fills this significant gap by explaining how the Rota functioned-its organization, the phases of a Rota process, everyday practices at the tribunal-and the kinds of issues it handled, where the processes originated from and how long they lasted. The study demonstrates that the Rota dealt with a range of cases much broader than has previously been acknowledged, whilst also confirming that the tribunal mainly oversaw litigation over benefices. The results of this research reveal the true role of the Rota and its significance for Christians from the middle ages to the dawn of the Reformation.
The Oxford Handbook of Criminal Law reflects the continued transformation of criminal law into a global discipline, providing scholars with a comprehensive international resource, a common point of entry into cutting edge contemporary research and a snapshot of the state and scope of the field. The book investigates a riveting, richly documented conflict from thirteenth-century England over church property and ecclesiastical patronage. Oliver Sutton, the bishop of Lincoln, and John St. John, a royal household knight, both used coveted papal provisions to bestow the valuable church of Thame to a familial clerical candidate (a nephew and son, respectively). Between 1292 and 1294 three people died over the right to possess this church benefice and countless others were attacked or publicly scorned during the conflict. More broadly, religious services were paralyzed, prized animals were mutilated, and property was destroyed. Ultimately, the king personally brokered a settlement because he needed his knight for combat. Employing a microhistorical approach, this book uses abundant episcopal, royal, and judicial records to reconstruct this complex story that exposes in vivid detail the nature and limits of episcopal and royal power and the significance and practical business of ecclesiastical benefaction. It is impossible to understand how the medieval church functioned and, in turn, influenced the lay world within its care without understanding "canon law". This book examines its development from its beginnings to the end of the Middle Ages, updating its findings in light of recent scholarly trends. This second edition has been fully revised and updated by Melodie H. Eichbauer to include additional material on the early Middle Ages; the significance of the discovery of earlier versions of Gratian’s Decretum; and the new research into law emanating from secular authorities, councils, episcopal acta, and juridical commentary to rethink our understanding of the sources of law and canon law's place in medieval society. Separate chapters examine canon law in intellectual spaces; the canonical courts and their procedures; and, using the case studies of deviation from orthodoxy and marriage, canon law in the lives of people. The vast majority of studies on rulership in medieval Europe focus on one kingdom; one type of rule; or one type of ruler. This volume attempts to break that mold and demonstrate the breadth of medieval Europe and the various kinds of rulership within it. How Medieval Europe was Ruled aims to demonstrate the multiplicity of types of rulers and polities that existed in medieval Europe. The contributors discuss not just kings or queens, but countesses, dukes, and town leadership. We see that rulers worked collaboratively with one another both across political boundaries and within their own borders in ways that are not evident in most current studies of kingship, inhibited by too narrow a focus. While both regular canons and monasticism with its development into different orders have reached a roughly even level of coverage in research, the history of secular canons is a field which has hitherto been far less in focus of historian scholarship. This might be due to the fact that they did not form orders or congregations offering a systematic approach to their institutions. Hence the pieces of research carried out so far mostly deal with a single cathedral or collegiate chapter and do not expand on the phenomenon in general. Likewise, the present publication may not give a comprehensive survey but yet takes a comparative approach by regarding the establishment of secular canons in a European longitudinal section from the Polar Circle to Southern Italy. In this course, both cathedral and collegiate chapters in Scandinavian, German, Polish and Italian territories and the respective career paths canons took into them will be considered. In this course, the essays take only some brief recourses to the early middle ages, when canons maintained a cloistered vita communis, but rather turn their view to those centuries in the high and later middle ages up to reformation times, when the chapters reached their full implementation. The essays collected in this volume base on a session series held at the International Medieval Congress 2018 in Leeds. Medieval Scandinavia went through momentous changes. Regional power centres merged and gave birth to the three strong kingdoms of Denmark, Norway, and Sweden. At the end of the Middle Ages, they together formed the enormous Kalmar Union comprising almost all lands around the North Atlantic and the Baltic Sea. In the Middle Ages, Scandinavia became part of a common Europe, yet preserved its own distinct cultural markers. Studies of conflict in medieval history and related disciplines have recently come to focus on wars, feuds, rebellions, and other violent matters. While those issues are present here, to form a backdrop, this volume brings other forms of conflict in this period to the fore. With these assembled essays on conflict and collaboration in the Iberian Peninsula, it provides an insight into key aspects of the historical experience of the Iberian kingdoms during the Middle Ages. Ranging in focus from the fall of the Visigothic kingdom and the arrival of significant numbers of Berber settlers to the functioning of the Spanish Inquisition right at the end of the Middle Ages, the articles gathered here look both at cross-ethnic and interreligious meetings in hostility or fruitful cohabitation. The book does not, however, forget intra-communal relations, and consideration is given to the mechanisms within religious and ethnic groupings by which conflict was channeled and, occasionally, collaboration could ensue.
