Negotiating Rural Land Ownership in Southwest China offers the first comprehensive analysis of how China’s current system of land ownership has evolved over the past six decades. Based on extended fieldwork in Yunnan Province, the author explores how the three major rural actors—local governments, village communities, and rural households—have contested and negotiated land rights at the grassroots level, thereby transforming the structure of rural land ownership in the People’s Republic of China. At least two million rural settlements (or “natural villages”) are estimated to exist in China today. Formed spontaneously out of settlement choices over extended periods of time, these rural settlements are fundamentally different from the present-day administrative villages imposed by the government from above. Yi Wu’s historical ethnography sheds light on such “natural villages” and their role in shaping the current land ownership system. Drawing on local land disputes, archival documents, and rich local histories, the author unveils their enduring social identities in both the Maoist and reform eras. She pioneers the concept of “bounded collectivism” to describe what resulted from struggles between the Chinese state trying to establish collective land ownership, and rural settlements seeking exclusive control over land resources within their traditional borders. A particular contribution of this book is that it provides a nuanced understanding of how and why China’s rural land ownership is changing in post-Mao China. Yi Wu uses village-level data to show how local governments, rural communities, and rural households compete for use, income, and transfer rights in both agricultural production and the land market. She demonstrates that the current rural land ownership system in China is not a static system imposed by the state from above, but a constantly changing hybrid.

Heaven Has Eyes is a comprehensive but concise history of Chinese law and justice from the imperial era to the post-Mao era. Never before has a single book treated the traditional Chinese law and judicial practices and their modern counterparts as a coherent history, addressing both criminal and civil justice. The legal-judicial reform agendas that emerged in the beginning of the twentieth century (and are still ongoing today) stemmed from this change in Chinese moral and legal thinking, but to materialize the said principles in everyday practices is a very different order of things, and the past century was fraught with legal dramas and tragedies. Heaven Has Eyes lays out how and why that is the case.

This book is the first Western-language monograph on the study of the Qingshui River manuscripts. By examining over 3,000 contracts and other manuscripts, this book offers constructive insights into the long-standing question of how and why a society in late imperial China could maintain a well-functioning social system with few laws but many contracts, i.e., Hobbesian “words without sword.” Three interrelated questions, what contracts were, how and why they worked, are explained successively. Thus, this book presents a non-stereotypical “contract society” in southwest China, arguing that the social order which provides predictability and regularity for economic prosperity could be formed and maintained through contracts even under the condition of relatively weak influence of governmental and legal authorities. This book benefits readers who are interested in law, society, and history. The decollectivization of Chinese agriculture in the early post-Mao period is widely recognized as a critical part of the overall reform program. But the political process leading to this outcome is poorly understood. A number of approaches have dominated the existing literature: 1) a power/policy struggle between Hua Guofeng’s alleged neo-Maoists and Deng Xiaoping’s reform coalition; 2) the power of the peasants; and 3) the leading role of provincial reformers. The first has no validity, while second and third must be viewed through more complex lenses. This study provides a new interpretation challenging conventional wisdom. Its key finding is that a game changer emerged in spring 1980 at the time Deng replaced Hua as CCP leader, but the significant change in policy was not a product of any clash between these two leaders. Instead, Deng endorsed Zhao Ziyang’s policy initiative that shifted emphasis away from Hua’s pro-peasant policy of increased resources to the countryside, to a pro-state policy that reduced the rural burden on national coffers. To replace the financial resources, policy measures including household farming were implemented with considerable provincial variations. The major unexpected production increases in 1982 confirmed the arrival of decollectivization as the template on the ground. The dynamics of this policy change has never been adequately explained. Paradoxes of Post-Mao Rural Reform offers a deep empirical study of critical developments involving politics from the highest levels in Beijing to China’s villages, and in the process challenges many broader accepted interpretations of the politics of reform. It is essential reading for students and scholars of contemporary Chinese political history.
