This book, the result of a congressionally mandated study, examines the adequacy of the regulatory framework for mining of hardrock mineralsâ€"such as gold, silver, copper, and uraniumâ€"on over 350 million acres of federal lands in the western United States. These lands are managed by two agenciesâ€"the Bureau of Land Management in the Department of the Interior, and the Forest Service in the Department of Agriculture. The committee concludes that the complex network of state and federal laws that regulate hardrock mining on federal lands is generally effective in providing environmental protection, but improvements are needed in the way the laws are implemented and some regulatory gaps need to be addressed. The book makes specific recommendations for improvement, including: The development of an enhanced information management system and a more efficient process to review new mining proposals and issue permits. Changes to regulations that would require all mining operations, other than "casual use" activities that negligibly disturb the environment, to provide financial assurances for eventual site cleanup. Changes to regulations that would require all mining and milling operations (other than casual use) to submit operating plans in advance.
Originally published in 1987, John D. Leshy presents this scholarly study of the 1872 Mining Law as a legal treatise and history of mining in the West from the point of view of mineral exploration and production. This mining law governed the United States mining practice yet had never been changed. The Mining Law attempts to highlight the role of policy and government as well as the more obscure elements of the law which complicated mining practice in the eighties. This title will be of interest to students of Environmental Studies and policy makers.

In this historical and comparative study, Christopher McGrory Klyza explores why land-management policies in mining, forestry, and grazing have followed different paths and explains why public-lands policy in general has remained virtually static over time. According to Klyza, understanding the different philosophies that gave rise to each policy regime is crucial to reforming public-lands policy in the future. Klyza begins by delineating how prevailing policy philosophies over the course of the last century have shaped each of the three land-use patterns he discusses. In mining, the model was economic liberalism, which mandated privatization of public lands; in forestry, it was technocratic utilitarianism, which called for government ownership and management of land; and in grazing, it was interest-group liberalism, in which private interests determined government policy. Each of these philosophies held sway in the years during which policy for that particular resource was formed, says Klyza, and continues to animate it even today.
The Office of Industrial Technologies (OIT) of the U. S. Department of Energy commissioned the National Research Council (NRC) to undertake a study on required technologies for the Mining Industries of the Future Program to complement information provided to the program by the National Mining Association. Subsequently, the National Institute for Occupational Safety and Health also became a sponsor of this study, and the Statement of Task was expanded to include health and safety. The overall objectives of this study are: (a) to review available information on the U.S. mining industry; (b) to identify critical research and development needs related to the exploration, mining, and processing of coal, minerals, and metals; and (c) to examine the federal contribution to research and development in mining processes.
On October 11, 2000, a breakthrough of Martin County Coal Corporation's coal waste impoundment released 250 million gallons of slurry in near Inez, Kentucky. The 72-acre surface impoundment for coal processing waste materials broke through into a nearby underground coal mine. Although the spill caused no loss of human life, environmental damage was significant, and local water supplies were disrupted. This incident prompted Congress to request the National Research Council to examine ways to reduce the potential for similar accidents in the future. This book covers the engineering practices and standards for coal waste impoundments and ways to evaluate, improve, and monitor them; the accuracy of mine maps and ways to improve surveying and mapping of mines; and alternative technologies for coal slurry disposal and utilization. The book contains advice for multiple audiences, including the Mine Safety and Health Administration, the Office of Surface Mining, and other federal agencies; state and local policymakers and regulators; the coal industry and its consultants; and scientists and engineers.
