Excerpt: ... intituled: "An Act to establish a Supreme Court and a Cdurt of Exchequer for the Dominion of Canada," and also of provisions contained in the Act 38th Victoria, chapter 12, intituled: " An Act to provide for the institution of suits against the Crown by petition of right, and respecting procedure in Crown suits," ms ordered that the following Rules, m respect of the niatters hereafter mentioned, shall be in force in the Exchequer Court of Canada. REVENUE causes. RULE 1. Mode of Procedure in Revenue causes arising in any Province except Province of Quebec.In the several classes of cases mentioned in Section 58 of the said Act, hereafter in these Rules styled " Revenue Causes," where the cause of action or suit shall arise in any of the Provinces other than the Province of Quebec, whether the same be instituted by or on behalf of the Crown, or against the Crown, or any officer thereof, and whether the same be in the nature of a suit in equity or of an action at law, the process, practice, evidence, times for taking proceedings, forms and modes of procedure shall conform, as near as may be, to the process, practice, evidence, times, forms and modes of procedure in use in like causes in the Exchequer Division of Her Majesty's High Court of Justice in England, except in so far as it may be otherwise provided by the said Act, or by these Rules. RULE 2. In causes arising in Province of Quebec.--In all causes in the said Exchequer Court including non-Revenue causes as well as Revenue causes, where the cause of action or suit shall arise in the Province of Quebec, the process, practice, pleadings, evidence, and forms and modes of procedure shall conform, as near as may be, to those in use in like causes...
