The concept of sustainable development is a source of inspiration for many, who see it as a call to cooperative action. In practice, however, policies intended to further this goal often generate conflicts of interest. The ensuing disputes occur among governmental organizations, but disputes also arise between public authorities, private interest groups, and the environmental movement. In the opinion of the authors, the fact that environmental policy can provoke such conflict may be attributed largely to decision making procedures in our society. Environmental protection is fundamental for the establishment of sustainable peace. Applying traditional legal approaches to protection raises particular challenges during the transition from conflict to peace. In the jus post bellum context, protection of the environment and natural resources needs to be considered in tandem with a broad range of simultaneously applicable normative frameworks, such as human rights, transitional justice, arms control/disarmament, UN law and practice, development, and domestic law. While certain multilateral environment agreements, such as the Convention Concerning the Protection of the World Cultural and Natural Heritage protect the environment; international humanitarian law and international criminal law continue to treat environmental protection largely from an anthropocentric perspective. This book is the first targeted work in the legal literature that investigates environmental challenges in the aftermath of conflict. Our lives increasingly take place in ever more complex and interconnected networks that blur the boundaries we have traditionally used to define our social and political spaces. Accordingly, the policy problems that governments are called upon to deal with have become less clear-cut and far messier. This is particularly the case with climate change, environmental policy, transport, health and ageing - all areas in which the tried-and-tested linear policy solutions are increasingly inadequate or failing. What makes messy policy problems particularly uncomfortable for policy makers is that science and scientific knowledge have themselves become sources of uncertainty and ambiguity. Indeed what is to count as a 'rational solution' is itself now the subject of considerable debate and controversy. This book focuses on the intractable conflict that characterises policy debate about messy issues. The author first develops a framework for analysing these conflicts and then applies the conceptual framework to four very different policy issues: the environment - focussing on climate change - as well as transport, ageing and health. Using evidence from Europe, North America and the Asia-Pacific, the book compares how policy actors construct contending narratives in order to make sense of, and deal with, messy challenges. In the final section the author discusses the implications of the analysis for collective learning and adaptation processes. Why can some environmental problems be resolved in one locale but remain contentious in another, often carrying on for decades? What is it about certain issues or the people involved that make a conflict seemingly insoluble. Making Sense of Intractable Environmental Conflicts addresses those and related questions, examining what researchers and experts in the field characterize as "intractable" disputes—intense disputes that persist over long periods of time and cannot be resolved through consensus-building efforts or by administrative, legal, or political means. The approach focuses on the "frames" parties use to define and enact the dispute—the lenses through which they interpret and understand the conflict and critical conflict dynamics.
