By examining the intersection of Islamic law, state law, religion, and culture in the Egyptian nation-building process, Recasting Islamic Law highlights how the sharia, when attached to constitutional commitments, is reshaped into modern Islamic state law. Rachel M. Scott analyzes the complex effects of constitutional commitments to the sharia in the wake of the Egyptian Revolution of 2011. She argues that the sharia is not dismantled by the modern state when it is applied as modern Islamic state law, but rather recast in its service. In showing the particular forms that the sharia takes when it is applied as modern Islamic state law, Scott pushes back against assumptions that introductions of the sharia into modern state law result in either the revival of medieval Islam or in its complete transformation. Scott engages with premodern law and with the Ottoman legal legacy on topics concerning Egypt's Coptic community, women's rights, personal status law, and the relationship between religious scholars and the Supreme Constitutional Court. Recasting Islamic Law considers modern Islamic state law's discontinuities and its continuities with premodern sharia. Religious leaders and reformers have always had a hard time in their day. They have been ridiculed and rejected and many of those who supposedly accepted them have been either weak in spirit or manifest enemies in disguise. Subsequent generations of the faithful have clashed in their understanding of the master’s teachings, spawning the rise of different interpretations. Moses and Jesus were troubled not only by their enemies but also by weak people among the faithful. Islam was not destined to fare much better. Historical accuracy was sacrificed to meet the needs of a divided community. And in due course, Islam’s sacred scripture, essentially a compilation of revelations to Muhammad, was hijacked by literalists, who distorted its message. A Closer Look at Islam attempts to show that the arguments of some critics are based largely on misinformation and that Islam would be better understood by a more serious study of its scripture and the lives of some of its role models. This book draws on newly available archives from the Iraqi state and Ba'th Party to present a revisionist history of Saddam Hussein's religious policies. The point of doing this, other than to correct the current understanding of Saddam's political use of religion through his presidency, is to argue that the policies promoted then directly contributed to the rise of religious insurgencies in post-2003 Iraq as well as the current and probably future crises in the country. In looking at Saddam's policies in the 1990s, many have interpreted his support for state religion as evidence of a dramatic shift away from Arab nationalism, toward political Islam. But this book shows that the 'Faith Campaign' he launched during this time was the culmination of a plan to use religion for political ends, begun upon his assumption of the Iraqi presidency in 1979. At this time, Saddam began constructing the institutional capacity to control and monitor Iraqi religious institutions. The resulting authoritarian structures allowed him to employ Islamic symbols and rhetoric in public policy, but in a controlled manner. By the 1990s, these policies became fully realized. Following the American-led invasion of Iraq in 2003, religion remained prominent in Iraqi public life, but the system that Saddam had put in place to contain it was destroyed. Sunni and Shi'i extremists who had been suppressed and silenced were now free. They thrived in an atmosphere where religion had been actively promoted, and formed militant organizations which have torn the country apart since.
Khaled Abou El Fadl, a prominent critic of Islamic puritanism, leads off this lively debate by arguing that Islam is a deeply tolerant religion. Injunctions to violence against nonbelievers stem from misreadings of the Qur'an, he claims, and even jihad, or so-called holy war, has no basis in Qur'anic text or Muslim theology but instead grew out of social and political conflict.
