An insider’s account of a wrongful conviction and the fight to overturn it during the civil rights era This book is an insider’s account of the case of Freddie Pitts and Wilbert Lee, two Black men who were wrongfully charged and convicted of the murder of two white gas station attendants in Port St. Joe, Florida, in 1963, and sentenced to death. Phillip Hubbart, a defense lawyer for Pitts and Lee for more than 10 years, examines the crime, the trial, and the appeals with both a keen legal perspective and an awareness of the endemic racism that pervaded the case and obstructed justice. Hubbart discusses how the case against Pitts and Lee was based entirely on confessions obtained from the defendants and an alleged “eyewitness” through prolonged, violent interrogations and how local authorities repeatedly rejected later evidence pointing to the real killer, a white man well known to the Port St. Joe police. The book follows the case’s tortuous route through the Florida courts to the defendants’ eventual exoneration in 1975 by the Florida governor and cabinet. From Death Row to Freedom is a thorough chronicle of deep prejudice in the courts and brutality at the hands of police during the civil rights era of the 1960s. Hubbart argues that the Pitts-Lee case is a piece of American history that must be remembered, along with other similar incidents, in order for the country to make any progress toward racial reconciliation today. Cone explores these symbols and their interconnection in the history and souls of black folk. Both the cross and the lynching tree represent the worst in human beings and at the same time a thirst for life that refuses to let the worst determine our final meaning. While the lynching tree symbolized white power and "black death," the cross symbolizes divine power and "black life" God overcoming the power of sin and death. Between 1880 and 1930, thousands of African Americans were lynched in the United States. Beyond the horrific violence inflicted on these individuals, lynching terrorized whole communities and became a defining characteristic of Southern race relations in the Jim Crow era. As spectacle, lynching was intended to serve as a symbol of white supremacy. Yet, Jonathan Markovitz notes, the act's symbolic power has endured long after the practice of lynching has largely faded away. Legacies of Lynching examines the evolution of lynching as a symbol of racial hatred and a metaphor for race relations in popular culture, art, literature, and political speech. Markovitz credits the efforts of the antilynching movement with helping to ensure that lynching would be understood not as a method of punishment for black rapists but as a terrorist practice that provided stark evidence of the brutality of Southern racism and as America's most vivid symbol of racial oppression. Cinematic representations of lynching, from Birth of a Nation to Do the Right Thing, he contends, further transform the ways that American audiences remember and understand lynching, as have disturbing recent cases in which alleged or actual acts of racial violence reconfigured stereotypes of black criminality. Markovitz further reveals how lynching imagery has been politicized in contemporary society with the example of Clarence Thomas, who condemned the Senate's investigation into allegations of sexual harassment during his Supreme Court confirmation hearings as a "high-tech lynching." Even today, as revealed by the 1998 dragging death of James Byrd in Jasper, Texas, and the national soul-searching it precipitated, lynchingcontinues to pervade America's collective memory. Markovitz concludes with an analysis of debates about a recent exhibition of photographs of lynchings, suggesting again how lynching as metaphor remains always in the background of our national discussions of race and racial relations. Beginning with the 1760s, when lynching and vigilantism came into existence in what is now the United States, this bibliography fills a void in the history of American collective violence. It covers over 4,200 works dealing with vigilante movements and lynchings, including books, articles, government documents, and unpublished theses and dissertations. Following a chapter listing general works, the book is arranged into four chronological chapters, a chapter on the frontier West, a chapter on anti-lynching, and chapters on literature and art. The book opens with a chapter devoted to general works. It then includes chapters on the period from the Colonial era to the Civil War, the Civil War through 1881, and the periods from 1882 to 1916 and 1917 to 1996. The work then turns to the frontier West and to anti-lynching bills, laws, organizations, and leaders. Finally, the book includes chapters on vigilantism in literature and art.
Lynchings: Extralegal Violence in Florida during the 1930s This study examines the 13 lynchings that occurred in the southern state of Florida during the decade of the 1930s. It provides a lively and detailed narrative account of each lynching and concludes that there is no one single theory or explanation of these extralegal executions. The author does, however, reveal several patterns common to these separate acts of vigilantism. For example, most Florida lynchings were not rural, small-town ceremonial hangings of black males accused of sexual offenses. Rather, the majority of lynch victims were forcibly seized from police and shot by small bands of carefully organized vigilantes rather than frenzied mobs. Moreover, one third of these lynchings occurred in urban areas. The study finishes with a brief overview of the three Florida lynchings of the 1940s and the sudden end of this southern lynch law in modern America.
