Presenting feminist readings of texts from the legal philosophical and jurisprudential canon, the papers collected here offer an interdisciplinary and critical challenge to established modes of reading law. Feminist approaches to law usually take the form of either critical engagements with legal doctrine, legal concepts and ideas, or critical assessments of the effects that specific areas of law have upon the lives of women. This collection, however, although rooted in feminist legal scholarship, takes the established canon of legal texts as the object of inquiry. Taking as their common starting point the fact that legal texts are plural and open to multiple readings, all the contributions in this collection offer subversive, but supplementary, interpretations of the legal canon. In this respect, however, they do not merely sustain an array of feminist styles and theories of reading; revealing and re-appropriating the plural space of legal interpretation, they seek to open a hitherto unexplored arena for a feminist politics of law. In this interdisciplinary study of gender, cross-cultural encounters, and federal Indian policy, Margaret D. Jacobs explores the changing relationship between Anglo-American women and Pueblo Indians before and after the turn of the century. During the late nineteenth century, the Pueblos were often characterized by women reformers as barbaric and needing to be "uplifted" into civilization. By the 1920s, however, the Pueblos were widely admired by activist Anglo-American women, who challenged assimilation policies and worked hard to protect the Pueblos? "traditional" way of life. ø Deftly weaving together an analysis of changes in gender roles, attitudes toward sexuality, public conceptions of Native peoples, and federal Indian policy, Jacobs argues that the impetus for this transformation in perception rests less with a progressively tolerant view of Native peoples and more with fundamental shifts in the ways Anglo-American women saw their own sexuality and social responsibilities.
This volume provides one of the first comprehensive feminist readings of international statebuilding, with a specific focus on the case of Kosovo. Rather than simply showing how the state in Kosovo is being built by and through women and feminist encounters, this volume is interested to problematise women and feminist subjectivities vis-à-vis the state and statebuilding. The book challenges three main arguments related to the processes and subjects of statebuilding in Kosovo. First, the academic literature on Kosovo has a tendency to take the international intervention of 1999 as the originary point of statebuilding processes in Kosovo. Second, and relatedly, given Kosovo's unprecedented exposure to Western intervention and statebuilding, the majority of works start from the presumption that liberal interventionism in Kosovo (and elsewhere) is normatively more progressive than the previous system, and that the liberal interventionism and statebuilding are naturally gender progressive and gender-equal. The third argument has to do with the existing legal architecture on gender and women’s rights in contemporary Kosovo. The aim of the volume is to, on the one hand, problematise the evidence against the backdrop of everyday manifestations and/or performances of statebuilding and on the other hand interrogate the co-constitutive gender aspect. In terms of methodology, the volume brings together contributions that rely on traditional and multi-sited ethnography, and narrative research rooted in projects and initiatives in Kosovo. This allows the contributors to unearth new and silenced actors, entry points, subjects and subjectivities in processes of and related to statebuilding in Kosovo; feminist frictions and challenges to statebuilding in Kosovo; as well as encounters of heteronormative statebuilding. This book will be of much interest to students of statebuilding, Balkan politics, feminisms, and international relations, in general.
This work builds on earlier works, which defend Confucianism against charges of sexism and present interpretations of Confucianism compatible with Feminism, but contributors go beyond the much discussed care ethics, and common arguments of how ren (humaneness) can ground an egalitarian humanism that include gender equality. Besides ethics and political philosophy topics, this volume includes discussions in other philosophical areas such as epistemology, metaphysics, and applied philosophy.
