This book addresses the importance of bilingualism in legal education. Written by respected experts in the field, it presents reports on bilingual legal education in countries with such diverse cultures and histories as Belgium, Canada, China, the Czech Republic, Finland, France, Germany, Italy, Japan, Mexico, Romania, Singapore, Taiwan and the USA. The findings are also summarized in a General Report that was presented at the 20th IACL General Congress in Fukuoka, Japan.
This book presents a multidisciplinary overview of a little known interethnic conflict in the southernmost part of the Americas: the tensions between the Mapuche indigenous people and the settlers of European descent in the Araucania region, in southern Chile. Politically autonomous during the colonial period, the Mapuche had their land confiscated, their population decimated and the survivors displaced and relocated as marginalized and poor peasants by Chilean white settlers at the end of the nineteenth century, when Araucania was transformed in a multi-ethnic region marked by numerous tensions between the marginalized indigenous population and the dominant Chileans of European descent. This contributed volume presents a collection of papers which delve into some of the intercultural dilemmas posed by these complex interethnic relations. These papers were originally published in Spanish and French and provide a sample of the research activities of the Núcleo de Estudios Interétnicos e Interculturales (NEII) at the Universidad Católica de Temuco, in the capital of Araucania. The NEII research center brings together scholars from different fields: sociocultural anthropology, sociolinguistics, ethno-literature, intercultural education, intercultural philosophy, ethno-history and translation studies to produce innovative research in intercultural and interethnic relations. The chapters in this volume present a sample of this work, focusing on three main topics: The ambivalence between the inclusion and exclusion of indigenous peoples in processes of nation-building. The challenges posed by the incorporation of intercultural practices in the spheres of language, education and justice. The limitations of a functional notion of interculturality based on eurocentric thought and neoliberal economic rationality. Intercultural Studies from Southern Chile: Theoretical and Empirical Approaches will be of interest to anthropologists, linguists, historians, philosophers, educators and a range of other social scientists interested in intercultural and interethnic studies.
Over the past decades, an increasingly influential Political Philosophy approach has been seen to defend issues relating to cultural injustices. The daily struggles arising from political agendas within different societies confirm this. This perspective can be summarised using the Hegelian expression “struggle for recognition”, and it is this expression that underpins the current position of minorities members and their defenders. This means that misrecognition, disrespect, and humiliation form the base of (cultural) injustices and must be avoided. Minorities are a fundamental part of democratic societies, but their rights have not always been respected. Inmigrants are currently the object of xenophobic campaigns. Rome people, the European minority, face additional difficulties, which results in them being key players in cases of indiret discrimination. The distribution of territorial power and the situation of national minorities have been causes of different political problems.“Who am I? Where do I belong?” are questions asking for indentity. Some people argue these should be relevant issues when applying the criminal law, circle of moral incumbency to cover animals -non humans-, arguing that they of life that involves their survival as a whole. Those groups are faced with members and their defenders.This publication is part of the “New Challenges of Law” project. Indigenous peoples around the world are calling for control over their education in order to reaffirm their identities and defend their rights. In Latin America the indigenous peoples, national governments and international organisations have identified intercultural education as a means of contributing to this process. The book investigates education for and by indigenous peoples and examines the relationship between theoretical and methodological developments and formal practice. An ethnographic study of the Arakmbut people of the Peruvian Amazon, provides a detailed example of the social, cultural and educational change indigenous peoples are experiencing, an insight into Arakmbut oral learning and teaching practices as well as a review of their conceptualisations of knowledge, pedagogy and evaluation. The models of intercultural education being promoted by Latin American governments are, nevertheless, biliterate and school-based. The book analyses indigenous and non-indigenous models based on different conceptualisations of culture and curriculum in the context of the Arakmbut search for an education which respects their dynamic oral cultural traditions and identity, provides them with a qualitatively relevant education about the wider society and addresses the intercultural lives they lead.
The objective of the following collected volume is to encourage a critical reflection on the relationship between "power" and "non-power" in our contemporary "world" and, proceeding from various philosophical traditions, to investigate the multifaceted aspects of this relationship. The authors’ respective investigations proceed from an intercultural perspective and fall predominantly in the domain of political theory and philosophy. This volume takes an intercultural political perspective, which means, on the one hand, involving non-European philosophies in a global debate about power relations and their effects in the world and, on the other hand, confronting local traditions of thought with a global inquiry in order to enter into a philosophical-political dialogue with these traditions. An intercultural approach of this type to political philosophy seeks not only to join others in reflecting upon global problems, but also to decenter of our understanding of the world, drawing attention to new ways of thinking. Insofar as the authors of the planned volume deal with "concrete" philosophical-political problems unfolding in various regions of the world, they seek to shed light on burning issues like migration, human rights violations, dictatorship and language, global poverty, power asymmetries, experiences of injustice with the further goal of offering a particularly intercultural analysis of these problems along with approaches to resolving them. To date, there is no book that collects various essays from different countries and perspectives and poses political-philosophical problems from an intercultural point of view.
Citizenship and Disadvantaged Groups in Chile seeks to overcome an existing void in the literature of Latin American studies addressing the impact of Chile’s post dictatorial legal framework on its historically and structurally disadvantaged groups, concentrating on the various issues and challenges that affect them. Within its eleven chapters it explores the changing social and legal status of LGBTI people, the political disenfranchisement and the social exclusion that affects imprisoned individuals, the harshness of policing on poor and marginalized communities, the deprivation of indigenous peoples of meaningful rights, the vulnerability that affects workers as a consequence of the existing model of labor relations, the disenfranchisement that affects migrants seeking economic opportunities, the denial of citizenship to women involved in the prohibition of abortion, the unsatisfactory regulation of sex work, the prevalence of domestic violence, and the absence of adequate means for disadvantaged groups to institutionalize their political representation. This book offers a distinctive contribution, focusing on a specific country in the Global South that is presently undergoing a process of economic consolidation while facing many of the problems of traditional and unequal Latin American societies.
This book argues that the effective protection of fundamental rights in a contemporary, multicultural society requires not only tolerance and respect for others, but also an ethics of reciprocity and a pursuit of dialogue between different cultures of human rights. Nowadays, all cultures tend to claim an equitable arrangement that can be articulated in the terms of fundamental rights and in the multicultural organization of the State. Starting from the premise that every culture is and always was intercultural, this book elaborates a new, and more fundamentally, pluralist view of the relationship between rights and cultural identity. No culture is pure; from the perspective of an irreducible cultural contamination, this book argues, it is possible to formulate constitutional idea of diversity that is properly intercultural. This concept of intercultural constitutionalism is not, then, based on abstract principles, but nor is it bound to any particular cultural norm. Rather, intercultural constitutionalism allows the interpretation of rights, rules and legal principles, which are established in different contexts.
