What institutional arrangements should a well-functioning constitutional democracy have? Most of the relevant literatures in law, political science, political theory, and economics address this question by discussing institutional design writ large. In this book, Adrian Vermeule moves beyond these debates, changing the focus to institutional design writ small. In established constitutional polities, Vermeule argues that law can and should - and to some extent already does - provide mechanisms of democracy: a repertoire of small-scale institutional devices and innovations that can have surprisingly large effects, promoting democratic values of impartial, accountable and deliberative government. Examples include legal rules that promote impartiality by depriving officials of the information they need to act in self-interested ways; voting rules that create the right kind and amount of accountability for political officials and judges; and legislative rules that structure deliberation, in part by adjusting the conditions under which deliberation occurs transparently or instead secretly. Drawing upon a range of social science tools from economics, political science, and other disciplines, Vermeule carefully describes the mechanisms of democracy and indicates the conditions under which they can succeed.

Based on the policy-making structures of Venezuelan government, this book examines the constitutionally allocated powers of the executive and legislature and shows how the powers of each branch are exercised given the incentives established by the electoral system and changing partisan strengths. Several institutional characteristics have led to a passive legislature and an activist chief executive. The advantages presidents enjoy as a result of their constitutional and partisan powers are demonstrated by a wealth of empirical evidence, including records of votes of censure, initiation of legislation, and the use of decree authority. Because of its dominance, the Venezuelan executive branch is the focus of interest-group pressure, which is institutionalized through consultative commissions and a decentralized public administration. The author analyzes memberships of more than 300 advisory commissions and governing boards, revealing the preponderance of posts filled by umbrella agencies for business and labor. The interaction of this limited version of civil society with policy makers in the executive branch has led to a highly protectionist development strategy and excessive government subsidies. The strategy and the political process that made it possible were both exhausted by the end of the 1980s. Venezuela was in political and economic crisis. The author places Venezuela in a comparative context with other Latin American states on three issues: the likelihood that executives will receive disciplined, majority support in the legislature; the constitutional powers of presidents; and the degree to which business and labor are formally incorporated through single peak associations. Participation and policy-making processes vary significantly across Latin American democracies, with few others reaching the level of centralization that has characterized Venezuela. At the other end of the spectrum, some Latin American institutional designs are characterized by diffusion and fragmentation. In conclusion, the author offers a blueprint to modify some of the counterproductive patterns associated with Venezuela, one of the longest-lived but now troubled democracies in Latin America.
What are the essential elements of a democracy? How can nations ensure a political voice for all citizens, and design a government that will respond to those varied voices? Analyzing three decades worth of comprehensive data on Latin American presidential campaigns, they find that primaries impart a stamp of legitimacy on candidates, helping to engage voters and mitigate distrust in the democratic process. And Kanchan Chandra proposes a paradigm shift in the way we think about ethnic inclusion in democracies: nations should design institutions that actively promote—rather than merely accommodate—diversity. At a moment when democracy seems vulnerable both at home and abroad, Designing Democratic Government sorts through a complex array of practices and institutions to outline what works and what doesn't in new and established democracies alike. The result is a volume that promises to change the way we look at the ideals of democracy worldwide.
In virtually every democratic nation in the world, political representation is defined by where citizens live. In the United States, for example, Congressional Districts are drawn every 10 years as lines on a map. Why do democratic governments define political representation this way? Are territorial electoral constituencies commensurate with basic principles of democratic legitimacy? And why might our commitments to these principles lead us to endorse a radical alternative: randomly assigning citizens to permanent, single-member electoral constituencies that each looks like the nation they collectively represent? Using the case of the founding period of the United States as an illustration, and drawing from classic sources in Western political theory, this book describes the conceptual, historical, and normative features of the electoral constituency. As an institution conceptually separate from the casting of votes, the electoral constituency is little studied. Its historical origins are often incorrectly described. And as a normative matter, the constituency is almost completely ignored. Raising these conceptual, historical and normative issues, the argument culminates with a novel thought experiment of imagining how politics might change under randomized, permanent, national electoral constituencies. By focusing on how citizens are formally defined for the purpose of political representation, The Concept of Constituency thus offers a novel approach to the central problems of political representation, democratic legitimacy, and institutional design.
The 1990s have witnessed the ascendance of a new orthodoxy which asserts that democracy and development are mutually reinforcing. This is in marked contrast to the dominant consensus that held sway for the previous two decades, which stated that developmental progress in poor societies was best assured by strong states, ruled by authoritarian regimes. Today, however, many new democracies are illiberal, non-participatory, and characterized by enormous inequalities. Developmental democracy cannot therefore be regarded as an assured outcome of a simultaneous process of economic and political liberalization. The central inquiry of this important new study concerns the extent to which it is possible to strive towards a new form of developmental state that can promote broad-based and equitable development in the context of legitimized, inclusive democracy. The argument running through this book is that there is scope for continuous political intervention in the design of democratic institutions that shape the context of state-led development initiatives. Institutional arrangements which foster political participation, the dispersion of political power, and increased representation by women and other disadvantaged groups can make democratic regimes more sensitive to issues of poverty, social welfare, and gender discrimination through remedial action and policy commitments. The authors of this book have developed a new and stimulating approach to the analysis of the transitions of Bulgaria, the Czech Republic, Hungary, and Slovakia to democracy and a market economy. They integrate interdisciplinary theoretical work with elaborate empirical data on some of the most challenging events of the twentieth century. Three groups of phenomena and their causal interconnection are explored: the material legacies, constraints, habits and cognitive frameworks inherited from the past; the erratic configuration of new actors, and new spaces for action; and a new institutional order under which agency is institutionalized and the sustainability of institutions is achieved. The book studies the interrelations of national identities, economic interests, and political institutions with the transformation process, concentrating on issues of constitution making, democratic infrastructure, the market economy, and social policy.
Through practices of collaborative imagination and making, or "doing design otherwise,” design experiments can contribute to keeping local democracies vibrant. In this counterpoint to the grand narratives of design punditry, Carl DiSalvo presents what he calls “doing design otherwise.” Arguing that democracy requires constant renewal and care, he shows how designers can supply novel contributions to local democracy by drawing together theory and practice, making and reflection. The relentless pursuit of innovation, uncritical embrace of the new and novel, and treatment of all things as design problems, says DiSalvo, can lead to cultural imperialism. In Design as Democratic Inquiry, he recounts a series of projects that exemplify engaged design in practice. These experiments in practice-based research are grounded in collaborations with communities and institutions. The projects DiSalvo describes took place from 2014 to 2019 in Atlanta. Rather than presume that government, industry—or academia—should determine the outcome, the designers began with the recognition that the residents and local organizations were already creative and resourceful. DiSalvo uses the projects to show how design might work as a mode of inquiry. Resisting heroic stories of design and innovation, he argues for embracing design as fragile, contingent, partial, and compromised. In particular, he explores how design might be leveraged to facilitate a more diverse civic imagination. A fundamental tenet of design is that the world is made, and therefore it could be made differently. A key concept is that democracy requires constant renewal and care. Thus, designing becomes a way to care, together, for our collective future.
Constitution-making for democracy has always been a highly political and contested process. It has never been more ambitious, or more difficult, than today as politicians and experts attempt to build democratic institutions that will foster peace and stability in countries torn by violent conflict. The extended investigation out of which this book has grown has ranged across three continents. It has examined such apparently intractable cases as Bosnia-Herzegovina, Sri Lanka and Fiji, as well as apparent 'success stories' like South Africa, Ghana and Uganda. Three groups of questions are explored: * How and by whom were democratic institutions (re)designed? * How have they functioned in practice: what has been the relationship between democratic institutions and democratic politics? * How have they measured up to the pressures placed on them by ongoing violence, poverty, globalization and democratization itself? The authors, while regarding democracy as a general entitlement, refuse to subscribe to a triumphalist view which sees it as a universal panacea. Instead they seek to understand how democratic institutions actually facilitate (or sometimes fail to facilitate) improved governance and the management of conflict in a variety of national settings. This thoughtful and empirical set of explorations is highly relevant to other societies wrestling with similar problems of institutional design in situations of democratic transition and/or deep-seated social conflict.
