Canada has been known as a hot spot for HIV criminalization where the act of not disclosing one’s HIV-positive status to sex partners has historically been regarded as a serious criminal offence. Criminalized Lives describes how this approach has disproportionately harmed the poor, Black and Indigenous people, gay men, and women in Canada. In this book, people who have been criminally accused of not disclosing their HIV-positive status, detail the many complexities of disclosure, and the violence that results from being criminalized. Accompanied by portraits from artist Eric Kostiuk Williams, the profiles examine whether the criminal legal system is really prepared to handle the nuances and ethical dilemmas faced everyday by people living with HIV. By offering personal stories of people who have faced criminalization first-hand, Alexander McClelland questions common assumptions about HIV, the role of punishment, and the violence that results from the criminal legal system’s legacy of categorizing people as either victims or perpetrators. Note: A regrettable error appears on page 22. The number 240 should be 206 when referring to the number of people prosecuted in relation to allegations of HIV nondisclosure. This will be fixed in future reprints.
This first comprehensive study of Chicanas encountering the U.S. criminal justice system is set within the context of the international war on drugs as witnessed at street level in Chicana/o barrios. Chicana Lives and Criminal Justice uses oral history to chronicle the lives of twenty-four Chicana pintas (prisoners/former prisoners) repeatedly arrested and incarcerated for non-violent, low-level economic and drug-related crimes. It also provides the first documentation of the thirty-four-year history of Sybil Brand Institute, Los Angeles' former women's jail. In a time and place where drug war policies target people of color and their communities, drug-addicted Chicanas are caught up in an endless cycle of police abuse, arrest, and incarceration. They feel the impact of mandatory sentencing laws, failing social services and endemic poverty, violence, racism, and gender discrimination. The women in this book frankly discuss not only their jail experiences, but also their family histories, involvement with gangs, addiction to drugs, encounters with the juvenile and adult criminal justice systems, and their successful and unsuccessful attempts to recover from addiction and reconstitute fractured families. The Chicanas' stories underscore the amazing resilience and determination that have allowed many of the women to break the cycle of abuse. Díaz-Cotto also makes policy recommendations for those who come in contact with Chicanas/Latinas caught in the criminal justice system.
Young Criminal Lives is the first cradle-to-grave study of the experiences of some of the thousands of delinquent, difficult and destitute children passing through the early English juvenile reformatory system. The book breaks new ground in crime research, speaking to pressing present-day concerns around child poverty and youth justice, and resonating with a powerful public fascination for family history. Using innovative digital methods to unlock the Victorian life course, the authors have reconstructed the lives, families and neighbourhoods of 500 children living within, or at the margins of, the early English juvenile reformatory system. Four hundred of them were sent to reformatory and industrial schools in the north west of England from courts around the UK over a fifty-year period from the 1860s onwards. Young Criminal Lives is based on one of the most comprehensive sets of official and personal data ever assembled for a historical study of this kind. For the first time, these children can be followed on their journey in and out of reform and then though their adulthood and old age. The book centres on institutions celebrated in this period for their pioneering new approaches to child welfare and others that were investigated for cruelty and scandal. Both were typical of the new kind of state-certified provision offered, from the 1850s on, to children who had committed criminal acts, or who were considered 'vulnerable' to predation, poverty and the 'inheritance' of criminal dispositions. The notion that interventions can and must be evaluated in order to determine 'what works' now dominates public policy. But how did Victorian and Edwardian policy-makers and practitioners deal with this question? By what criteria, and on the basis of what kinds of evidence, did they judge their own successes and failures? Young Criminal Lives ends with a critical review of the historical rise of evidence-based policy-making within criminal justice. It will appeal to scholars and students of crime and penal policy, criminologists, sociologists, and social policy researchers and practitioners in youth justice and child protection.
Complicated Lives focuses on the lives of sixty-five drug-using girls in the juvenile justice system (living in group homes, a residential treatment center, and a youth correctional facility) who grew up in families characterized by parental drug use, violence, and child maltreatment. Vera Lopez situates girls’ relationships with parents who fail to live up to idealized parenting norms and examines how these relationships change over time, and ultimately contribute to the girls’ future drug use and involvement in the justice system. While Lopez’s subjects express concerns and doubt in their chances for success, Lopez provides an optimistic prescription for reform and improvement of the lives of these young women and presents a number of suggestions ranging from enhanced cultural competency training for all juvenile justice professionals to developing stronger collaborations between youth and adult serving systems and agencies.

There is currently a huge growth of interest in histories of crime, and intellectual conversations and connections between historians and criminologists are becoming much more frequent. However, published work which uses historical data to this extent is rare. Criminal Lives uses historical data to directly address modern criminological debates and engages a wide audience in a genuinely interdisciplinary analysis. This book addresses a number of important questions about offenders' persistence in, or distance from, crime and questions the current theoretical frameworks that are given to explain why some people stop, or slow down, their offending, and why offenders' children become involved in crime. By using criminal registers, census material, and newspaper reports from 1880 -1940 for one industrial town in North-West England, this book asks how and why did some people stop offending, what part did employment, relationship formation, and family responsibility play in that process; was criminality passed on from parent to child, and if so, how; and to what extent were persistent offenders also persistent victims?
