In the third issue of the J. Paul Getty Trust Occasional Papers in Cultural Heritage Policy series, authors Helen Frowe and Derek Matravers pivot from the earlier tone of the series in discussing the appropriate response to attacks on cultural heritage with their paper, “Conflict and Cultural Heritage: A Moral Analysis of the Challenges of Heritage Protection.” While Frowe and Matravers acknowledge the importance of cultural heritage, they assert that we must more carefully consider the complex moral dimensions—the inevitable serious consequences to human beings—before formulating policy to forcefully protect it. A number of writers and thinkers working on the problem of preserving the world’s most treasured monuments, sites, and objects today cite what Frowe and Matravers call extrinsic and intrinsic justifications for the protection of cultural heritage. These are arguments that maintain that protecting heritage will be a key means to achieve other important goals, like the prevention of genocide, or arguments that heritage deserves to be forcefully protected for its own sake. Frowe and Matravers deconstruct both types of justifications, demonstrating a lack of clear evidence for a causal relationship between the destruction of cultural heritage and atrocities like genocide and arguing that the defense of heritage must not be treated with the same weight or urgency, or according to the same international policies, as the defense of human lives. By calling for expanded theory and empirical data and the consideration of morality in the crafting of international policy vis-à-vis cultural heritage protection, Frowe and Matravers present a thoughtful critique that enriches this important series and adds to the ongoing dialogue in the field.

This book analyses the current legal framework seeking to protect cultural heritage during armed conflict and discusses proposed and emerging paradigms for its better protection. Cultural heritage has always been a victim of conflict, with monuments and artefacts frequently destroyed as collateral damage in wars throughout history. In addition, works of art have been viewed as booty by victors and stolen in the aftermath of conflict. However, deliberate destruction of cultural sites and items has also occurred, and the Intentional destruction of cultural heritage has been a hallmark of recent conflicts in the Middle East and North Africa, where we have witnessed unprecedented, systematic attacks on culture as a weapon of war. In Iraq, Syria, Libya, Yemen, and Mali, extremist groups such as ISIS and Ansar Dine have committed numerous acts of iconoclasm, deliberately destroying heritage sites, and looting valuable artefacts symbolic of minority cultures. This study explores how the international law framework can be fully utilised in order to tackle the destruction of cultural heritage, and analyses various paradigms which have recently been suggested for its better protection, including the Responsibility to Protect paradigm and the peace and security paradigm. This volume will be an essential resource for scholars and practitioners in the areas of public international law, especially international humanitarian law and cultural heritage law.

Conflict, Heritage and World-Making in the Chaco documents and interprets the physical remains and afterlives of the Chaco War (1932–35) – known as South America’s first ‘modern’ armed conflict – in what is now present-day Paraguay. It focuses not only on archaeological remains as conventionally understood, but takes an ontological approach to heterogeneous assemblages of objects, texts, practices and landscapes shaped by industrial war and people’s past and present engagements with them. These assemblages could be understood to constitute a ‘dark heritage’, the debris of a failed modernity. Yet it is clear that they are not simply dead memorials to this bloody war, but have been, and continue to be active in making, unmaking and remaking worlds – both for the participants and spectators of the war itself, as well as those who continue to occupy and live amongst the vast accretions of war matériel which persist in the present.
The world's cultural heritage is currently not only threatened by time, nature, and human development but increasingly by armed conflicts. We see destructions caused by looting and illicit traffic but also iconoclasm and manipulations of cultural heritage for political, religious, economic, and propaganda reasons. Revenues of illegal selling are often used to finance conflicts as illustrated in the Da'esh business model example in this publication. Cultural Property Protection (CPP), while legally mandatory under national and international law, is poorly implemented and sanctions are rarely enforced. There is however, a constant and international demand for education and outcomes of multidisciplinary research on the topic, especially in the context of conflict and crime. Research must include military perspectives, and common mechanisms connected to abuse and protection. Outcomes should contain academic conceptualization, as well as practice based solutions to diminish and mitigate damage. To meet demands while expanding, and following up on their previous work Military Involvement in Cultural Property Protection: An Overview (Joint Force Quarterly, JFQ 74, 3rd Quarter 2014 July 2014) the authors wrote this publication. It contains a selection of field case examples and incorporates recent developments and trends. All ingredients serve to feed research and dialogue about the use and abuse of cultural heritage especially in the event of conflict, with a focus on cooperation and coordination between civil stakeholders and military parties. A selection of identified fundamental CPP problems is discussed as part of a comparative analysis with field examples such as the Dugong case, an illustration of overlap between cultural and natural heritage coined as hybrid heritage. Other cases include events in Libya, Estonia, Iraq, Syria, Turkey and Mali. All are weighed against Rittel's wicked problems theory and other concepts while involving new notions of securitization, politicization, memorialization and propagandization of cultural property. Last but not least, the authors signal within circles of IO's, NGO's and Governmental parties involved in the management and protection of heritage, an increase of bureaucratic behavior and political use of mankind's cultural heritage contributing to the current deplorable situation.

The human cost in any conflict is of course the first care in terms of the reduction, if not the elimination of damage. However, the destruction of archaeology and heritage as a consequence of civil and international wars is also of major concern, and the irreversible loss of monuments and sites through conflict has been increasingly discussed and documented in recent years. Post-Conflict Archaeology and Cultural Heritage draws together a series of papers from archaeological and heritage professionals seeking positive, pragmatic and practical ways to deal with conflict-damaged sites. For instance, by showing that conflict-damaged cultural heritage and archaeological sites are a valuable resource rather than an inevitable casualty of war, and suggesting that archaeologists use their skills and knowledge to bring communities together, giving them ownership of, and identification with, their cultural heritage. The book is a mixture of the discussion of problems, suggested planning solutions and case studies for both archaeologists and heritage managers. Cultural heritage is material – tangible and intangible – that signifies a culture’s history or legacy. It has become a venue for contestation, ranging in scale from protesting to violently claimed and destroyed. But who defines what is to be preserved and what is to be erased? As cultural heritage becomes increasingly significant across the world, the number of issues for critical analysis and, hopefully, mediation, arise. The issue stems from various groups: religious, ethnic, national, political, and others come together to claim, appropriate, use, exclude, or erase markers and manifestations of their own and others’ cultural heritage as a means for asserting, defending, or denying critical claims to power, land, and legitimacy. Can cultural heritage be well managed and promoted while at the same time kept within parameters so as to diminish contestation? The cases herein rage from Greece, Spain, Egypt, the UK, Syria, Zimbabwe, Italy, the Balkans, Bénin, and Central America.
