This volume of the "Yearbook of the European Convention on Human Rights, prepared by the Directorate of Human Rights of the Council of Europe, relates to 2003. Part one contains information on the Convention. Part two deals with the control mechanism of the European Convention on Human Rights: selected judgments of the European Court of Human Rights and human rights (DH) resolutions of the Committee of Ministers; part three groups together the other work of the Council of Europe in the field of human rights, and includes the work of the Committee of Ministers, the Parliamentary Assembly and the Directorate General of Human Rights; part four is devoted to information on national legislation and extracts from national judicial decisions concerning rights protected by the Convention. Appendix A contains a bibliography on the Convention, and Appendix B the biographies of the new judges elected to the European Court of Human Rights.
Au courant de l'annee rg6r le mecanisme de protection des droits de l'homme institue par la Convention a, pour la premiere fois, fonctionne dans son integralite. La Commission, la Cour et le Comite des Ministres ont, en effet, exerce les fonctions que leur assigne la Convention. Les juristes suivent, depuis 1955 deja, la jurisprudence de la Commission qui apporte une importante contribution au droit international general. L'annee rg6r leur fournit une plus ample matiere avec le premier arret sur le fond jamais rendu dans le domaine des droits de l'homme par un tribunal international. C'est le rer juillet rg6r que la Cour europeenne des Droits de l'Homme a prononce son arret dans l'affaire Lawless, mettant ainsi fin au litige introduit devant la Commission par un particulier contre son propre gouvernement. A cet arret vient s'ajouter la decision prise dans l'affaire Nielsen par le Comite des Ministres du Conseil de l'Europe le 25 octobre rg6r.
The Committee of Ministers of the Couneil of Europe by a Re solution of 6th February 1960, authorised the publication of a Yearbook of the European Convention on Human Rights. The Yearbook, the first volume of which appeared in 1959 under the title "European Commission of Human Rights - Documents and Decisions", will in future be published each year in the month of September. The Yearbook, being prepared by the Directorate of Human Rights of the Council of Europe, does not involve the responsibility either of the European Commission or of the European Court of Human Rights. In partieular, the summaries of the decisions of the European Commission of Human Rights eannot be quoted against the actual texts of the decisions eontained in the first and second volumes. Volume I3 of the Yearbook of the European Convention on Human Rights relates to the year I970 and reflects a return to the usual pattern of activity under the Convention during that year, after the exceptional situation produced in I969 by the "Greek Case". This volume is published somewhat later than usual, because an extra volume in this series has been published between volumes I2 and I3 containing the Report of the European Com mission of Human Rights and the Resolution of the Committee of Ministers of the Council of Europe relating to the "Greek Case". Part I of this Volume contains, as usual, the basic texts, chief among which are the amendments now made to the Convention following the entry into force on 2I September I970 of the Third Protocol, which relates to the procedure of the Commission. On the same date, the Second Protocol also entered into force, conferring on the Court of Human Rights competence to give advisory opinions. The text of this Protocol is to be found in Volume 6 at pages 3ff. The amendments and additions to the Rules of Court consequent upon the entry into force of the Second Protocol are set out in Part I of this Volume.
