Who controls American immigration policy? The biggest immigration controversies of the last decade have all involved policies produced by the President policies such as President Obama's decision to protect Dreamers from deportation and President Trump's proclamation banning immigrants from several majority-Muslim nations. While critics of these policies have been separated by a vast ideological chasm, their broadsides have embodied the same widely shared belief: that Congress, not the President, ought to dictate who may come to the United States and who will be forced to leave. This belief is a myth. In The President and Immigration Law, Adam B. Cox and Cristina M. Rodríguez chronicle the untold story of how, over the course of two centuries, the President became our immigration policymaker-in-chief. Diving deep into the history of American immigration policy from founding-era disputes over deporting sympathizers with France to contemporary debates about asylum-seekers at the Southern border they show how migration crises, real or imagined, have empowered presidents. Far more importantly, they also uncover how the Executive's ordinary power to decide when to enforce the law, and against whom, has become an extraordinarily powerful vehicle for making immigration policy. This pathbreaking account helps us understand how the United States ?has come to run an enormous shadow immigration system-one in which nearly half of all noncitizens in the country are living in violation of the law. Perception and representation of newcomers and immigrants The topic of migration has become particularly contentious in national and international debates. Media have a discernable impact on overall societal attitudes towards this phenomenon. Polls show time and again that immigration is one of the most important issues occupying people’s minds. This book examines the dynamic interplay between media representations of migrants and refugees on the one hand and the governmental and societal (re)actions to these on the other. Visualizing Law in the Age of the Digital Baroque explores the profound impact that visual digital technologies are having on the practice and theory of law. Today, lawyers, judges, and lay jurors face a vast array of visual evidence and visual argument. From videos documenting crimes and accidents to computer displays of their digital simulation, increasingly, the search for fact-based justice inside the courtroom is becoming an offshoot of visual meaning making. But when law migrates to the screen it lives there as other images do, motivating belief and judgment on the basis of visual delight and unconscious fantasies and desires as well as actualities. Law as image also shares broader cultural anxieties concerning not only the truth of the image but also the mimetic capacity itself, the human ability to represent reality. What is real, and what is simulation? This is the hallmark of the baroque, when dreams fold into dreams, like immersion in a seemingly endless matrix of digital appearances. When fact-based justice recedes, laws proliferate within a field of uncertainty. Left unchecked, this condition of ontological and ethical uneasiness threatens the legitimacy of law’s claim to power. Visualizing Law in the Age of the Digital Baroque offers a jurisprudential paradigm that is equal to the challenge that current cultural conditions present.
This book is a clear, systematic, original and lively account of how media representations shape the way we see our and others’ lives in a global age. It provides in-depth analysis of a range of international media representations of disaster, war, conflict, migration and celebration. The book explores how images, stories and voices, on television, the Internet, and in advertisements and newspapers, invite us to relocate to distant contexts, and to relate to people who are remote from our daily lives, by developing ‘mediated intimacy’ and focusing on the self. It also explores how these representations shape our self-narratives. Orgad examines five sites of media representation – the other, the nation, possible lives, the world and the self. She argues that representations can and should contribute to fostering more ambivalence and complexity in how we think and feel about the world, our place in it and our relation to far-away others. This open access book explores the use of visual methods in migration studies through a combination of theoretical analyses and empirical studies. The first section looks at how various visual methods, including photography, film, and mental maps, may be used to analyse the spatial presence of migrants. The second section addresses the processual building of narratives around migration, thereby using formats such as film and visual essay, and reflecting upon the ways they become carriers and mediators of both story and theory within the subject of migration. Section three focuses on vulnerable communities and discusses how visual methods can empower these communities, thereby also focusing on the theoretical and ethical implications of migration. The fourth section addresses the issue of migrant representation in visual discourses. Based on these contributions, a concluding methodological chapter systematizes the use of visual methods in migration studies across disciplines, with regard to their empirical, theoretical, and ethical implications.
