Torture and rape are only rarely considered by moral philosophers—because they are so indisputably morally atrocious acts and because their specific mode of suffering cannot be accounted for by reigning moral theories. By making them pivotal to the understanding of morality in general, however, Jay Bernstein’s intention is to throw into question the dominant schools of modern moral philosophy and to attempt to restructure moral experience and understanding on the basis of the formations of suffering they make salient. Morals, Bernstein argues, emerge from the experience of moral injury, from the sufferings of the victims of moral harm. For us moderns, morality at its most urgent and insistent is, finally, a victim morality. This can sound hyperbolic; but since all of us are potential victims, it turns out that this perspective is readily available and intrinsic to ordinary ethical experience. One of Bernstein’s pivotal arguments is that trust is a form of mutual recognition; that trust is the ethical substance of everyday life; and that understood aright trust is structured from the perspective of a potential victim of harm rather than from the perspective of a deliberating agent. This book promises to be a major contribution to moral philosophy.
Torture and Moral Integrity tackles a concrete moral problem that has been hotly debated by governments, scholars, and the media: the morality of interrogational torture. It discusses multiple types of torture with great philosophical acuity and seeks to explain why interrogational torture and other types of torture are always and everywhere morally wrong. During the past several decades, political philosophers have frequently clashed with one another over the question whether governments are morally required to remain neutral among reasonable conceptions of excellence and human flourishing. Whereas the numerous followers of John Rawls (and kindred philosophers such as Ronald Dworkin) have maintained that a requirement of neutrality is indeed incumbent on every system of governance, other philosophers -- often designated as 'perfectionists' -- have argued against the existence of such a requirement. Liberalism with Excellence enters these debates not by plighting itself unequivocally to one side or the other, but instead by reconceiving each of the sides and thus by redirecting the debates that have occurred between them. On the one hand, the book rejects the requirement of neutrality by contending that certain subsidies for the promotion of excellence in sundry areas of human endeavour can be proper and vital uses of resources by governments. Advocating such departures from the constraint of neutrality, the book presents a version of liberalism that can rightly be classified as 'perfectionist'. On the other hand, the species of perfectionism espoused in Liberalism with Excellence diverges markedly from the theories that have usually been so classified. Indeed, much of the book assails various aspects of those theories. What is more, the aspirational perfectionism elaborated in the closing chapters of the volume is reconcilable in most key respects with a suitably amplified version of Rawlsianism. Hence, by reconceiving both the perfectionist side and the neutralist side of the prevailing disputation, Liberalism with Excellence combines and transforms their respective insights.

It is about morality and ethics. The judgement has already been made that torture is unlawful. In addition, the Guantanamo Bay practices and the unlawful seizure of persons in different parts of the world by the CIA - after which they are transferred to countries where they are tortured - have proven that hard evidence is highly unlikely to be attained under torture. Most of the detainees have been proven to have no connection to terrorism and most of them have been released because they were wrongly arrested. Guantanamo represents a failed policy that has done much damage to the moral authority of the US. Aberrant views of torture as necessary because the ends justify the means have not generated much negative reaction from the legal profession - despite the fact that the 1984 Convention against Torture, the Geneva Conventions, the US Constitution, and the laws of the US have clearly prohibited such practices. This book examines such questions as: Are the events of September 11, 2001 enough to have us reopen the question of whether the medieval practice of torture should be allowed? Are they enough to have its institutionalized practice undermine the integrity of the US legal process and system of law, and to undermine the country's moral leadership in the world? The answer to these questions has to be a resounding and unqualified no. The US must, therefore, take quick and confident action to make amends and to hold responsible those who promoted a policy of torture. M.
