The oceans provide a great challenge for the development and management of planet earth by humankind. This book covers new approaches to the development of the law of the sea, the division of the oceans among states, and new thinking on institutions in depth.
This textbook provides the reader with a foundation in policy development and analysis and describes how policy, including legal mechanisms, is applied to marine environments around the world. It offers a systematic treatment of all aspects of marine policy, including environmental protection, fisheries, transportation, energy, mining and climate change. It starts with a biophysical overview of the structure and function of the marine environment with a particular emphasis on the challenges and opportunities of managing the marine environment. An overview of the creation and function of international law is then provided with a focus on international marine law. It explores the geographic and jurisdictional dimensions of marine policy, as well the current and anticipated challenges facing marine systems, including climate change-related impacts and resource over-exploitation. The book should appeal to senior undergraduate and graduate students and form a core part of the curriculum for marine affairs, science and policy courses. It will also provide supplementary reading for students taking a course in the law of the oceans, but is not aimed at legal specialists.

Marine Spatial Planning (MSP) is an integrated and comprehensive approach to ocean governance and is used to establish a rational use of marine space and reconcile conflicting interests of its users. MSP allows both a high level of environmental protection and a wide range of human activities and emphasizes coordinated networks of national, regional and global institutions. This book focuses on the framework of international law behind MSP and especially on the transboundary aspects of MSP. It first sets out a general framework for transboundary MSP and then moves on to compare and assess differences and similarities between different regions. Specific detailed case studies include the EU with the focus on the Baltic Sea and North Sea, the Bay of Bengal and Great Barrier Reef in Australia. The authors examine the national and regional significance of MSP from an integrated and sustainable ocean governance point of view. They also show how transboundary MSP can create opportunities and positive initiatives for cross-border cooperation and contribute to the effective protection of the regional marine environment.
It is a privilege to introduce the reader to this book, as I believe that it will make a signi?cant contribution to, given the dif?culties in the knowledge of the Indian Ocean, developing cooperation in the Indian Ocean region. There have been numerous failed efforts at regional cooperation in different fora in the Indian Ocean. As a result of the land-based orientation of the people in the region, the importance for countries to develop the power to govern the sea has largely been ignored. The maritime approach taken by Manoj Gupta to the Indian Ocean as a region in international relations offers a timely and critical assessment of the potential for regional cooperation and ocean governance. The political leadership in the region can no longer ignore the need for coop- ation in maritime affairs in the Indian Ocean. This book enriches the literature on Indian Ocean issues as it argues convincingly that the security of nations, economic well-being of the people and health of the Indian Ocean cannot be divested from one another.
