This book takes a riveting look at how the law responds to that distinctly American dream of immortality. While American law provides virtually no protections for the interests we hold most dear—our bodies and our reputations—when it comes to property interests, the American dead have greater control than anywhere else in the world. Moreover, these rights are growing daily. From grave robbery to Elvis impersonators, Madoff shows how the law of the dead has a direct impact on how we live. Madoff examines how the rising power of the American dead enables the deceased to exert control over their wealth forever through grandiose schemes like "dynasty trusts" and perpetual private charitable foundations and to control their creative works and identities well into the unforeseeable future. Madoff explores how the law of the dead can, in essence, extend the reach of life by granting virtual immortality to individuals. This article examines some legal and moral issues associated with two developing areas of biomedicine; cloning and cryonics. The author firstly considers the practical benefits to society of developing perfecting and utilizing the process of cloning. These include the ability to overcome inheritable genetic defects and the provision of organs for transplantation. Against this must be weighed some moral and ethical problems of genetic engineering. Professor Smith then discusses the process of deep-freezing a person and the development of cryonics as a social movement. The major legal problem stemming from cryonics is determining the time at which a cryonically suspended individual dies, important in settling his estate. The author concludes that these difficult problems in biomedicine are to be resolved not by avoidance, but by striking a careful balance between individual need and social good.
In the 1960s Robert Ettinger founded the cryonics (cryonic hibernation) movement and authored THE PROSPECT OF IMMORTALITY. A new (2005) Introduction by Charles Tandy is entitled "Ettinger's 1964 Thesis: Indefinitely Extended And Enhanced Life (Immortality) Is Probably Already Here Via Experimental Long-Term Suspended Animation" [[P: ]] James Bedford began his journey as "the first cryonaut" on January 12, 1967; as of 2005, he and many others remain in cryonic hibernation. According to Ettinger, cryonic hibernation (experimental long-term suspended animation) of humans may provide a "door into summer" unlike any season previously known. Such patients (individuals and families in cryonic hibernation) may yet experience the transhuman condition. Ettinger argues for his belief in "the possibility of limitless life for our generation." We should become aware of the incorrect, distorted, and oversimplified ideas presented in the popular media about cryonics. He believes that the cool logic and scientific evidence he presents should lead us to forget the horror movies and urban legends and embrace great expectations.
