This text collates and examines the jurisprudence that currently exists in respect of blood-tied genetic connection, arguing that the right to identity often rests upon the ability to identify biological ancestors, which in turn requires an absence of adult-centric veto norms. It looks firstly to the nature and purpose of the blood-tie as a unique item of birthright heritage, whose socio-cultural value perhaps lies mainly in preventing, or perhaps engendering, a feared or revered sense of ‘otherness.’ It then traces the evolution of the various policies on ‘telling’ and accessing truth, tying these to the diverse body of psychological theories on the need for unbroken attachments and the harms of being origin deprived. The ‘law’ of the blood-tie comprises of several overlapping and sometimes conflicting strands: the international law provisions and UNCRC Country Reports on the child’s right to identity, recent Strasbourg case law, and domestic case law from a number of jurisdictions on issues such as legal parentage, vetoes on post-adoption contact, court-delegated decision-making, overturned placements and the best interests of the relinquished child. British Victorians were obsessed with fluids—with their scarcity and with their omnipresence. In The Social Life of Fluids Jules Law traces the fantasies of power and anxieties of identity precipitated by these developments as they found their way into the plotting and rhetoric of the Victorian novel. Analyzing the expression of scientific understanding and the technological manipulation of fluids—blood, breast milk, and water—in six Victorian novels (by Charles Dickens, George Eliot, George Moore, and Bram Stoker), Law traces the growing anxiety about fluids in Victorian culture from the beginning of the sanitarian movement in the 1830s through the 1890s. Fluids, he finds, came to be regarded as the most alienable aspect of an otherwise inalienable human body, and, paradoxically, as the least rational element of an increasingly rationalized environment. Drawing on literary and feminist theory, social history, and the history of science and medicine, Law shows how fluids came to be represented as prosthetic extensions of identity, exposing them to contested claims of kinship and community and linking them inextricably to public spaces and public debates.

On Saturday, September 22, 1928, Barbara Griffiths, age four, strayed into the woods surrounding the upstate village of Massena, New York. Hundreds of people looked everywhere for the child but could not find her. At one point, someone suggested that Barbara had been kidnapped and killed by Jews, and as the search continued, policemen and townspeople alike gave credence to the quickly spreading rumors. The allegation of ritual murder, known to Jews as “blood libel,” took hold. To believe in the accusation seems bizarre at first glance—blood libel was essentially unknown in the United States. But a great many of Massena’s inhabitants, both Christians and Jews, had emigrated recently from Central and Eastern Europe, where it was all too common.
