The debate on law, governance and constitutionalism beyond the state is confronted with new challenges. In the EU, confidence in democratic transnational governance has been shaken by the authoritarian and unsocial practices of crisis management. The ambition of this book, which builds upon many years of close co-operation between its contributors, is to promote a viable interdisciplinary alternative to these developments. “Conflicts-law constitutionalism” is a concept of transnational governance which derives democratic legitimacy from the supranational control of the external impact of national decision-making, on the one hand, and the co-operative responses to problem interdependencies on the other. The first section of the book contrasts Europe's new modes of economic governance and crisis management with the conditionality of international investments, and reflects upon the communalities and differences between emergency Europe and global exceptionalism. Subsequent sections substantiate the problématique of executive and technocratic rule, explore conflict constellations of prime importance in the fields of environmental and labour law, and discuss the impact and limits of liberalisation strategies. Throughout the book, European and transnational developments are compared and evaluated.

In the wake of the euro crisis, the European Union has been transformed in many ways. Is it now on the right track? The euro crisis, the steps taken to manage it, and the resulting transformations have triggered a necessary process of reconsidering economic governance in the European Union. This volume— the third in a series of annual editions tackling different aspects of governance— examines the long list of open political, legal, and economic questions related to the functioning and fundamental structure of the Union as a whole and the economic and monetary union in particular. This book assesses the many changes that have occurred within the European Parliament and in its external relations since the Lisbon treaty (2009) and the last European elections (2014). It is undoubtedly the institution that has evolved the most since the 1950s. Despite the many crises experienced by European integration in the last years, the Parliament is still undergoing important changes in its formal competences, its influence on policy-making, its relations with other EU institutions, its internal organisation and its internal political dynamics. Every contribution deals with the most recent aspects of these evolutions and addresses overlooked topics, providing an overview of the current state of play which challenges the mainstream intergovernmental approach of the EU. This project results from research conducted at the Department of European Political and Governance Studies of the College of Europe. Individual research of several policy analysts of the European Parliamentary Research Service (EPRS) have contributed to this endeavour.
This book analyzes the state of global governance in the current geopolitical environment. It evaluates the main challenges and discusses potential opportunities for compromise in international cooperation. The book’s analysis is based on the universal criteria of global political stability and the UN framework of sustainable development. Annotation. Far-reaching transformations in the nature of contemporary governance can be observed, within and beyond the nation-state. At the heart of these transformations, Jonathan Zeitlin argues, is the emergence of new forms of 'experimentalist' governance, based on framework rule-making and revision through comparative review of alternative approaches to advancing common objectives in different local contexts. The proliferation of these new organizational forms can best be understood as a response to increased environmental volatility and complexity, which have overwhelmed in many settings the capacities of conventional hierarchical governance and 'command-and-control' regulation. Although robust examples can be found in many jurisdictions, including the United States, the epicenter of these developments is the European Union, where experimentalist governance arrangements have been institutionalized across a wide range of policy domains over the past 15 years. These have not only facilitated the extension of European integration into new, politically sensitive policy fields, but also enabled the EU in many areas to produce high-quality, revisable rules capable of broad application across a diverse polity of 500 million inhabitants and 27 member states. In this inaugural lecture,Zeitlin analyzes the properties of these experimentalist arrangements, examines their development within the EU, and opens up new research questions about their influence on governance processes within the member states and beyond the Union's borders.
