This book explains, compares and assesses the legal implications of Dieselgate within a range of selected jurisdictions and at the EU, international and comparative law level.The book analyses the US EPA-VW $14.7 billion dollar settlement of 2016, one of the largest civil settlements in the history of environmental law. As it shows, the Dieselgate affair has raised a host of issues concerning corporate and social responsibility, tort liability, environmental liability, contractual defective products, warranty, and false environmental claims in a range of jurisdictions. Issues like repurchasing or retrofitting cars from consumers and making direct payments to consumers through car buy-backs and compensation are analysed. Further, the book relates how Dieselgate has also contributed to the discussion about the introduction of more effective collective measures of redress for consumers, such as class actions, in Germany, France, Italy and the UK.The book subsequently reviews the criminal offences Volkswagen is currently confronted with in Germany, France and Italy, i.e. fraud and manipulation of capital markets (by belatedly providing shareholders with essential information relevant for the share value), and, potentially, environmental crimes. It demonstrates how Dieselgate has sparked new debates in Germany, Italy, France and the UK about the need to introduce enterprise liability for organised crimes, lack of compliance and control structures, and intentional violations of the law.Lastly, the book discusses how EU law has sought to respond to Dieselgate and thus investigates the controversial EU Regulation No. 2016/646 introducing a "temporary conformity factor" of 2.1 (equivalent to a 110% increase on the current limit) to be applied for NOx in the new RDE testing cycle, and the works of the EU committee of inquiry into Emissions Measurements in the Automotive Sector (EMIS).

The self-imposed Dieselgate was an expression of poor work by VW with inadequate decisionmaking by management, unethical corporate governance, and a lack of a duty of responsibility. VW faced three allegations of misconduct. Intended air pollution, breaking the rules and cheating on emissions tests. Therefore, the Dieselgate is used to analyze and explain the assertion “Not doing something can require investments” by referring to the ethical compass (EC). The study is going stepwise to explain the meaning of the assertion by giving a rough understanding of the Dieselgate (Chapter 2), analyzing the Dieselgate with the help of the EC to answer the question whether VW postponed its investments into the future or not (Chapter 3), transferring the analysis results to the general to define the real meaning of the assertion (Chapter 4) and then giving a conclusion (Chapter 5).

These conference proceedings constitute a selection of the best papers submitted to the 14th International Scientific Conference "Law in Business of Selected Member States of the European Union" which was organized by the Department of Business and European Law, Faculty of International Relations, Prague University of Economics and Business, Czech Republic. Is Euroscepticism still suited to analyze the variegated nature of opposition to the EU? Starting from this question, this book critically reviews Euroscepticism, reconceptualizes it in terms of political opposition and discovers, disentangles and explains patterns of EU-opposition within the European Parliament (EP). Distinguishing between “what the EU does” and “what the EU is”, the research elaborates an index of parties’ positioning “measuring” it through the speeches that parties’ deliver in the EP. The EP is the “perfect laboratory” where decisions concerning EU-policies are taken and the future EU-trajectories are shaped. Besides delineating a set of guidelines categorizing parties, the book concludes that their positioning varies along two main axes: the pro-anti-EU-system and the pro-anti-EU-establishment. From a normative perspective, the research argues for the growing importance of the “cumulation hypothesis”: if criticism remains unheard within the European elitist construct, such criticism will transform itself into rejection.

Environmental crimes are primarily driven by financial motives. The combined financial value of illicit trade in protected wildlife, illegal logging and waste trafficking is estimated to come directly after counterfeiting, the narcotic drugs trade and illegal gambling. Logically, the proceeds of these crimes must also be laundered. Goods, however, are not the only money maker for environmental criminals. Corporations may also try to ‘save’ costs by not complying with environmental regulations and thus commit crimes of omission rather than commission. From an enforcement and compliance perspective focusing on the proceeds of crime may therefore be an effective strategy.
