This book reconstructs the tradition of dialectic from Aristotle's "Topics," its founding text, up to its "renaissance" in 16th century Italy, and focuses on the role of dialectic in the production of knowledge. Aristotle defines dialectic as a structured exchange of questions and answers and thus links it to dialogue and disputation, while Cicero develops a mildly skeptical version of dialectic, identifies it with reasoning "in utramque partem" and connects it closely to rhetoric. These two interpretations constitute the backbone of the living tradition of dialectic and are variously developed in the Renaissance against the Medieval background. The book scrutinizes three separate contexts in which these developments occur: Rudolph Agricola's attempt to develop a new dialectic in close connection with rhetoric, Agostino Nifo's thoroughly Aristotelian approach and its use of the newly translated commentaries of Alexander of Aphrodisias and Averroes, and Carlo Sigonio's literary theory of the dialogue form, which is centered around Aristotle's "Topics." Today, Aristotelian dialectic enjoys a new life within argumentation theory: the final chapter of the book briefly revisits these contemporary developments and draws some general epistemological conclusions linking the tradition of dialectic to a fallibilist view of knowledge.
The period from Plato's birth to Aristotle's death (427–322 BC) is one of the most influential and formative in the history of Western philosophy. Between 1540 and 1580, authors such as Speroni, Tullia d’Aragona, the Venetian poligrafi, Tyard, Le Caron, Pasquier, Taillemont, Marguerite de Navarre, and Louise Labé, feature interlocutors not only deliberating on love but imitating the experience of love in their dynamics of speaking. These love dialogues allow early modern ideologies and discourses of love to be imitated by the reader and rival lyric poetry in conveying amorous experience, validating dialogue as an authentic literary form rather than a tool of philosophical thinking.
This book considers the emergence of dialectic out of the spirit of dialogue and traces the relation between the two. It moves from Plato, for whom dialectic is necessary to destroy incorrect theses and attain thinkable being, to Cusanus, to modern philosophers—Descartes, Kant, Hegel, Schleiermacher and Gadamer, for whom dialectic becomes the driving force behind the constitution of a rational philosophical system. Conceived as a logical enterprise, dialectic strives to liberate itself from dialogue, which it views as merely accidental and even disruptive of thought, in order to become a systematic or scientific method. Central to rhetorical theory, the enthymeme is most often defined as a truncated syllogism. Suppressing a premise that the audience already knows, this rhetorical device relies on the audience to fill in the missing information, thereby making the argument more persuasive. James Fredal argues that this view of the enthymeme is wrong. Presenting a new exegesis of Aristotle and classic texts of Attic oratory, Fredal shows that the standard reading of Aristotle’s enthymeme is inaccurate—and that Aristotle himself distorts what enthymemes are and how they work. From close analysis of the Rhetoric, Topics, and Analytics, Fredal finds that Aristotle’s enthymeme is, in fact, not syllogistic and is different from the enthymeme as it was used by Attic orators such as Lysias and Isaeus. Fredal argues that the enthymeme, as it was originally understood and used, is a technique of storytelling, primarily forensic storytelling, aimed at eliciting from the audience an inference about a narrative. According to Fredal, narrative rather than formal logic is the seedbed of the enthymeme and of rhetoric more broadly. The Enthymeme reassesses a fundamental doctrine of rhetorical instruction, clarifies the viewpoints of the tradition, and presents a new form of rhetoric for further study and use. In the course of a single investor-state dispute, an arbitrator may make numerous decisions, from interpreting the treaty or national laws to taking into account case law, customs and policies. In practice, this process raises important issues regarding the consistency of decisions and the predictability and legitimacy of the decision-making process in general. Investment arbitration tribunals have developed a specialised process of legal decision making adapted to the interpretational needs that arise in the context of an investor-state dispute and to the transnational characteristics of the investment arbitration framework. This is the first book to offer an in-depth analysis of the transnational characteristics of investment arbitration and to analyse the interpretive arguments of investment tribunals and the way they use treaties, precedent, policies, general principles of law and customary law in their decision-making process.
