He revives the legal realists' rich account of law as a growing institution accommodating three sets of constitutive tensions-power and reason, science and craft, and tradition and progress-and demonstrates how the major claims attributed to legal realism fit into this conception of law. Dagan seeks to rein in realist descendants who have become fixated on one aspect of the big picture, and to dispel the misconceptions that those gone astray represent the tradition accurately or that realism is now merely a historical signpost. He draws upon the realist texts of Oliver Wendell Holmes, Karl Llewellyn, and others to explain how legal realism offers important and unique jurisprudential insights that are not just a part of legal history, but are also relevant and useful for a contemporary understanding of legal theory. Building on this realist conception of law and enriching its texture, Dagan addresses more particular jurisprudential questions. The chapters in this volume are about moral dilemmas in two senses. First the authors focus on dilemmas, both real and hypothetical, which require moral judgements. The 'Heinz-Dilemma' part of Kohlberg's scoring systems is used as a point for level of moral development. There is also a Second sense, as those who study moral reasoning being in a dilemma as they attempt to integrate information from the domains of philosophy and psychology.
The theory of “literary worlds” has become increasingly important in comparative and world literatures. But how are the often-contradictory elements of Eastern and Western literatures to cohere in the new worlds such contact creates? Drawing on the latest work in philosophical logic and analytic Asian philosophy, this monograph proposes a new model of literary worlds that is best suited to comparative literature dealing with Western and East Asian traditions. Unlike much discussion of world literature anchored in North American traditions, featured here is the transnational work of artists, philosophers, and poets writing in English, French, Japanese and Mandarin in the twentieth century. Rather than imposing sharp borders, this book suggests that vague boundaries link Eastern and Western literary works and traditions, and that degrees of distance can better help us to see the multiple dimensions that both distinguish and join together literary worlds East and West. As such, it enables us to grasp not only how East Asian and Western writers translate one another’s works into their own languages and traditions, but also how modern writers East and West modify their own traditions in order to make them fit in the new constellation of literary worlds brought about by the complex flow of literary information across twentieth-century Eurasia.
