The first edition of State and Society in Nigeria, published in 1980, was and remains a dominant influence in teaching, research, policy and practice of state-society relations in Nigeria for more than a generation. The volume of essays has remained one of the most cited in the field testimony to its enduring content and perspective as well as the beauty, accessibility and clarity of its language. This new edition revisits, extends and reconsiders aspects of the first edition in light of developments in the literature since 1980 and offers new insights and interpretations on issues of political economy, politics, and sociology such as the countrys Civil War (1967-1970) the political economy of oil, debt, and democratization and the complexities and ethnic identities and rivalries and religious accommodation and conflict, and of the multiple ways in which they intersect with one another.
This book is on the study of resource utilization and management, a case study of the impact of state land ownership and land use regulation on development in Nigeria from 1955-1985. In 1978, the Federal Military Government of Nigeria promulgated a Land Use Decree whose objectives were to introduce a uniform land policy for the whole country, control hoarding and speculating in land, and facilitate the allocation of land for national development. However, critics of the decree argued that the new land policy amounted to nationalization of land in the country, and wondered whether such development strategy was appropriate in the 21st century In light of the foregoing this author examined the impact of the new land policy on development in Nigeria from 1955-1985, using qualitative and quantitative methods. The beginning and end of the study period coincide with the end of the colonial development plans that started in 1946 and ushered in Nigerias independence in 1960, and the end of the fourth national development plan of 1981-1985 under the military government that overthrew the civilian government in 1966, The study in this book is significant because of the importance of land as one of the most important factors of production in any society, others being labor, capital, entrepreneurship, and information resources. The implementation problems associated with the new land use law are highlighted. This author believes, however, that it is necessary that further research should be undertaken continually in the future, especially with a view to examining the effectiveness of the implementation experiences since the promulgation of the land use law in 1978.
Critical Issues in Nigerian Property Law, a collection of writings in honour of Professor Jelili Adebisi Omotola, SAN, a former Vice Chancellor of the University of Lagos, who died on the 29th of March 2006, has ten chapters that closely examine not only the current state of Property Law in Nigeria, but also recent developments and other challenges that have surfaced since the infamous Land Use Act of 1999. The book is clearly a useful contribution to a growing body of knowledge on property law and practice in Nigeria.
Despite growing consensus on the socio-economic benefits emanating from enhanced land tenure security, issues related to how best to measure it and what constitute universal indicators of tenure (in)security are poorly understood. As a result, issues of what drives tenure security are poorly understood and inconclusive. This study, thus, examines the drivers of perceived tenure insecurity in Nigeria using the Nigeria LSMS-Panel General Household Survey of 2012/13. The determinants of perceive tenure insecurity are assessed across two indicators: private (idiosyncratic) tenure risk and collective (covariate) tenure security risk. The analysis shows that perceived risks of private land dispute are higher for female-headed households, households with lower social/political connectedness, and for land parcels acquired via the traditional/customary system, in contrast to having been purchased. Private tenure risk/insecurity is also higher in communities with vibrant land market and for households that are located close to urban centers, while the opposite is the case in communities with relative ease of land access. On the other hand, collective tenure risk is lower in communities with improved economic status. Finally, signifying the need to account for intra-household dimensions in implementing land reform interventions, results from a more disaggregated analysis show that tenure security is relatively higher on female-managed plots of female-headed households, while the opposite is the case for female-managed plots of male-headed households.
In line with the conventional view that customary land rights impede agricultural development, the traditional tenure system in Nigeria has been perceived to obstruct the achievement of efficient development and agricultural transformation. This led to the Land Use Act (LUA) of 1978. As a remedial measure to the perceived inadequacy of the traditional tenure system, the act nationalized the control of all land, empowering state governors and local governments with administration and manage-ment of land.1 The act conferred on state governors the custodian right to provide use rights (i.e., the ‘right of occupancy’) for land users in their state, dissolving any possessory (freehold) rights to land which were granted by the customary system.
The variety of land questions facing Africa and the divergent strategies proposed to resolve them continue to evoke debates. Increasingly, in response to the enduring problems of land tenure, there are land movements of all shapes and orientations, some reformist and others quite revolutionary in their agenda. However revolutionary, land movements have tended to ignore the land tenure interests of women, pastoralists, youth and indigenous people. Several of these longstanding and emerging issues in land tenure include the role of the state in land tenure reforms; urban land questions, the nature of land struggles and improvements; and, the impact of land tenure developments on particular social groups and countries. An overarching concern is the extent to which land rights are being commodified, through the conversion of land held under customary tenure systems into marketised systems. The consequences of this include growing land concentration, land tenure insecurities, diminishing access to land by various sections of society, including the poor, women and less dominant ethno-religious groups. This volume brings together different studies on Africas land questions exploring emerging land issues on the continent in terms of the wider questions of development, citizenship, and democratisation. The chapters discuss the land question through a variety of themes. Some focus on the agrarian aspects of the land questions, while others elucidate the urban dimensions of the land question.
