From the early days of colonial rule in India, the British established a two-tier system of legal administration. Matters deemed secular were subject to British legal norms, while suits relating to the family were adjudicated according to Hindu or Muslim law, known as personal law. This important new study analyses the system of personal law in colonial India through a re-examination of women's rights. Focusing on Hindu law in western India, it challenges existing scholarship, showing how - far from being a system based on traditional values - Hindu law was developed around ideas of liberalism, and that this framework encouraged questions about equality, women's rights, the significance of bodily difference, and more broadly the relationship between state and society. Rich in archival sources, wide-ranging and theoretically informed, this book illuminates how personal law came to function as an organising principle of colonial governance and of nationalist political imaginations.

The role of markets in linking local communities to larger networks of commerce, culture, and political power is the central element in Anand A. Yang's provocative and original study. Yang uses bazaars in the northeast Indian state of Bihar during the colonial period as the site of his investigation. The bazaar provides a distinctive locale for posing fundamental questions regarding indigenous societies under colonialism and for highlighting less familiar aspects of colonial India. At one level, Yang reconstructs Bihar's marketing system, from its central place in the city of Patna down to the lowest rung of the periodic markets. But he also concentrates on the dynamics of exchanges and negotiations between different groups and on what can be learned through the "voices" of people in the bazaar: landholders, peasants, traders, and merchants. Along the way, Yang uncovers a wealth of details on the functioning of rural trade, markets, fairs, and pilgrimages in Bihar. A key contribution of Bazaar India is its many-stranded narrative history of some of South Asia's primary actors over the past two centuries. But Yang's approach is not that of a detached observer; rather, his own voice is engaged with the voices of the past and with present-day historians. This book examines the politics of social, cultural and political recognition of caste groups in North India. It explores the factors that make some castes politically influential, while others continue to remain socially and economically marginalized. The author situates these groups within democracy and utilizes a multicultural framework to understand why and when various castes have sought to achieve recognition and redistributive justice; to what extent different castes have been able to achieve these goals; and how civil society has engaged with these issues. Unlike dominant discourses on caste and democracy, which give primacy to electoral/procedural democracy over the substantive one, this book views the relationship between castes and the state in both dimensions of democracy.
