This book provides an analytical overview of the vast range of historiography which was produced in western Europe over a thousand-year period between c.400 and c.1500. Concentrating on the general principles of classical rhetoric central to the language of this writing, alongside the more familiar traditions of ancient history, biblical exegesis and patristic theology, this survey introduces the conceptual sophistication and semantic rigour with which medieval authors could approach their narratives of past and present events, and the diversity of ends to which this history could then be put. Classical Rhetoric in the Middle Ages: The Medieval Rhetors and Their Art 400-1300, with Manuscript Survey to 1500 CE is a completely updated version of John Ward’s much-used doctoral thesis of 1972, and is the definitive treatment of this fundamental aspect of medieval and rhetorical culture. It is commonly believed that medieval writers were interested only in Christian truth, not in Graeco-Roman methods of ‘persuasion’ to whatever viewpoint the speaker / writer wanted. Dr Ward, however, investigates the content of well over one thousand medieval manuscripts and shows that medieval writers were fully conscious of and much dependent upon Graeco-Roman rhetorical methods of persuasion. Inspiration and Authority in the Middle Ages rethinks the role of prophecy in the Middle Ages by examining how professional theologians responded to new assertions of divine inspiration. Drawing on fresh archival research and detailed study of unpublished manuscript sources from the twelfth to fourteenth centuries, this volume argues that the task of defining prophetic authority became a crucial intellectual and cultural enterprise as university-trained theologians confronted prophetic claims from lay mystics, radical Franciscans, and other unprecedented visionaries. In the process, these theologians redescribed their own activities as prophetic by locating inspiration not in special predictions or ecstatic visions but in natural forms of understanding and in the daily work of ecclesiastical teaching and ministry. Instead of containing the spread of prophetic privilege, however, scholastic assessments of prophecy from Peter Lombard and Thomas Aquinas to Peter John Olivi and Nicholas Trevet opened space for claims of divine insight to proliferate beyond the control of theologians. By the turn of the fourteenth century, secular Italian humanists could lay claim to prophetic authority on the basis of their intellectual powers and literary practices. The First Crusade (1095-1101) was the stimulus for a substantial boom in Western historical writing in the first decades of the twelfth century, beginning with the so-called "eyewitness" accounts of the crusade and extending to numerous second-hand treatments in prose and verse. From the time when many of these accounts were first assembled in printed form by Jacques Bongars in the early seventeenth century, and even more so since their collective appearance in the great nineteenth-century compendium of crusade texts, the Recueil des historiens des croisades, narrative histories have come to be regarded as the single most important resource for the academic study of the early crusade movement. But our understanding of these texts is still far from satisfactory. This ground-breaking volume draws together the work of an international team of scholars. It tackles the disjuncture between the study of the crusades and the study of medieval history-writing, setting the agenda for future research into historical narratives about or inspired by crusading. The basic premise that informs all the papers is that narrative accounts of crusades and analogous texts should not be primarily understood as repositories of data that contribute to a reconstruction of events, but as cultural artefacts that can be interrogated from a wide range of theoretical, methodological and thematic perspectives. This book builds on the success of the First International Conference on Facts and Evidence: A Dialogue between Law and Philosophy (Shanghai, China, May 2016), which was co-hosted by the Collaborative Innovation Center of Judicial Civilization (CICJC) and East China Normal University. The Second International Conference on Facts and Evidence: A Dialogue between Law and History was jointly organized by the CICJC, the Institute of Evidence Law and Forensic Science (ELFS) at China University of Political Science and Law (CUPL), and Peking University School of Transnational Law (STL) in Shenzhen, China, on November 16–17, 2019. Historians, legal scholars and legal practitioners share the same interest in ascertaining the “truth” in their respective professional endeavors. It is generally recognized that any historical study without truthful narration of historical events is fiction and that any judicial trial without accurate fact-finding is a miscarriage of justice. In both historical research and the judicial process, practitioners are invariably called upon, before making any arguments, to prove the underlying facts using evidence, regardless of how the concept is defined or employed in different academic or practical contexts. Thus, historians and legal professionals have respectively developed theories and methodological tools to inform and explain the process of gathering evidentiary proof. When lawyers and judges reconsider the facts of cases, “questions of law” are actually a subset of “questions of fact,” and thus, the legal interpretation process also involves questions of “historical fact.” The book brings together more than twenty leading history and legal scholars from around the world to explore a range of issues concerning the role of facts as evidence in both disciplines. Fresh approaches to one of the most important poems from medieval Scotland. John Barbour's Bruce, an account of the deeds of Robert I of Scotland (1306-29) and his companions during the so-called wars of independence between England and Scotland, is an important and complicated text. Composed c.1375 during the reign of Robert's grandson, Robert II, the first Stewart king of Scotland (1371-90), the poem represents the earliest surviving complete literary work of any length produced in "Inglis" in late medieval Scotland, andis usually regarded as the starting point for any worthwhile discussion of the language and literature of Early Scots. It has also been used as an essential "historical" source for the career and character of that iconic monarch Robert I. But its narrative defies easy categorisation, and has been variously interpreted as a romance, a verse history, an epic or a chivalric biography. This collection re-assesses the form and purpose of Barbour's great poem. It considers the poem from a variety of perspectives, re-examining the literary, historical, cultural and intellectual contexts in which it was produced, and offering important new insights.
