The Kansas Judicial Council agreed to undertake a study of judicial performance evaluations. The Council appointed a new advisory committee to undertake the study.
A study requested by the 2001 Kansas Legislature.
"Marla J. Luckert, Kansas Supreme Court Justice, requested that the Judicial Council Criminal Law Advisory Committee (Committee) study K.S.A. 22-4507(b) and its relation to the holding in State v. Robinson" [which] "held that a court must consider the defendant's ability to pay fees and the financial burden such would place on the defendant at the time of assessment. Similarly, K.S.A. 22-4507(b) requires that claims for compensation and reimbursement be certified by the claimant and presented to the court at sentencing." This "seems to trivialize the victim's and the defendant's situations. Justice Luckert asked the committee to see if it could come up with an alternative to address this concern."

Senator John Vratil requested that the Judicial Council study and report on K.S.A. 40-256 and K.S.A. 40-908, which allow an award of attorney's fees to a prevailing plaintiff in an action on an insurance policy. The Judicial Council assigned the study to the Civil Code Advisory Committee.
In May, 2010, the Kansas Supreme Court requested that the Judicial Council consider placing the crime of felony murder in a separate statute, so that it is neither a lesser degree of premeditated first degree murder for purposes of lesser included offenses, nor a greater degree of any other homicide.
