A study requested by the 1999 Kansas Legislature.
The 1999 Legislature requested the Kansas Judicial Council to study and report on several child in need of care issues. The Judicial Council accepted the study and appointed an advisory committee of diverse and extensive experience in the area to make the study.
House Judiciary Committee Chair Lance Kinzer requested that the Judicial Council study and make a formal or informal recommendation on 2009 HB 2208. The bill requires that all child in need of care reports be forwarded to the County or District Attorney's office prior to any investigation by Social and Rehabilitative Services (SRS). In its June, 2009, meeting, the Judicial Council agreed to undertake the study and assigned the task to the Juvenile Offender / Child in Need of Care (JO/CINC) Advisory Committee.
In May, 2010, House Committee on Corrections and Juvenile Justice Chair, Pat Colloton, requested that the Judicial Council study and make a recommendation on 2010 HB 2603. Current law allows for the expungement of certain juvenile records or files by application to the court where the records or files are maintained. 2010 HB 2603 would allow the expungement of juvenile records and files to be automatic under certain conditions.
The Kansas Supreme Court requested that the Judicial Council study appeals dealing with the termination of parental rights, with the goal being to expedite those appeals while preserving the due process rights of all involved. Those appeals ... may involve a child in need of care, adoption, or termination of parental rights. ... Because there are many views to consider when contemplating changes to appellate procedures, it was determined that a Judicial Council study would be an ideal forum to unite professionals from various parts of Kansas' juvenile legal system to consider procedures for further reducing appeal time in [these] cases. ... The Judicial Council agreed to undertake this study and created the Judicial Council Appeals From Termination of Parental Rights Advisory Committee.
In 2006, the Legislature passed the Revised Kansas Code for Care of Children and the Revised Kansas Juvenile Justice Code, both effective January 1, 2007. As with any significant code revision, some issues arise that require immediate attention while other issues become apparent only after some time has passed. The Judicial Council Juvenile Offender/Child in Need of Care Advisory Committee (Committee) worked with the 2007 Legislature to amend sections of the Codes that needed immediate change including sections relating to juvenile fingerprints and photographs, reading of reports pertaining to evaluation or development needs of the child, and service of process. Since then, the Committee has prepared practice forms for both the Revised Kansas Code for Care of Children and the Revised Kansas Juvenile Justice Code and in doing so, the Committee has identified several other areas that need to be amended. Some of the proposed amendments are technical in nature, some require clarification and some are required to remain in compliance with federal acts or regulations. The Committee proposes Senate Bill 435 to correct these problems.
In May, 2010, the House Committee on Corrections and Juvenile Justice requested that the Judicial Council study and make recommendations on 2010 House Bill 2502 which attempts to create a child witness protection act.
