This book provides a reimagining of how Western law and legal theory structures the human–earth relationship. As a complement to contemporary efforts to establish rights of nature and non-human legal personhood, this book focuses on the other subject in the human–earth relationship: the human. Critical ecological feminism exposes the dualistic nature of the ideal human legal subject as a key driver in the dynamic of instrumentalism that characterises the human–earth relationship in Western culture. This book draws on conceptual fields associated with the new sciences, including new materialism, posthuman critical theory and Big History, to demonstrate that the naturalised hierarchy of humans over nature in the Western social imaginary is anything but natural. It then sets about constructing a counternarrative. The proposed ‘Cosmic Person’ as alternative, non-dualised human legal subject forges a pathway for transforming the Western cultural understanding of the human–earth relationship from mastery and control to ideal co-habitation. Finally, the book details a case study, highlighting the practical application of the proposed reconceptualisation of the human legal subject to contemporary environmental issues. This original and important analysis of the legal status of the human in the Anthropocene will be of great interest to those working in legal theory, jurisprudence, environmental law and the environmental humanities; as well as those with relevant interests in gender studies, cultural studies, feminist theory, critical theory and philosophy.

Reimagining Political Ecology is a state-of-the-art collection of ethnographies grounded in political ecology. When political ecology first emerged as a distinct field in the early 1970s, it was rooted in the neo-Marxism of world system theory. This collection showcases second-generation political ecology, which retains the Marxist interest in capitalism as a global structure but which is also heavily influenced by poststructuralism, feminism, practice theory, and cultural studies. As these essays illustrate, contemporary political ecology moves beyond binary thinking, focusing instead on the interchanges between nature and culture, the symbolic and the material, and the local and the global. Aletta Biersack’s introduction takes stock of where political ecology has been, assesses the field’s strengths, and sets forth a bold research agenda for the future. Two essays offer wide-ranging critiques of modernist ecology, with its artificial dichotomy between nature and culture, faith in the scientific management of nature, and related tendency to dismiss local knowledge. Reimagining Urban Nature questions some of the underlying imaginaries which have for so long allowed us humans to develop technologically at great cost to the more-than-human world and ourselves. In urban places, cultural and more-than-human entities are in frequent contact; however, the non-human is often seen as expendable in these human-centric places. While much important work has been done on improving care for the more rural and wild areas of the globe, to really address environmental damage we must work towards reimagining the city. These are places where the majority of people live and work, and where the majority of decisions are made about the care and protection of many environments within and beyond the city. This book contributes to the still under-developed field of urban ecocriticism by adding a posthumanist perspective, as well as expanding current discussions within urban studies and environmental activism that seek to shift political and cultural imaginaries of urban nature. Importantly, this investigation is grounded in the Australian (and more broadly, the Australasian) context to allow for the analysis of a more diverse set of voices, texts and ecologies in an area still dominated by the northern hemisphere and the Global North.

Through their theoretical analysis, research and field work, the authors explore novel approaches to designing sustainability and sustainability education. These approaches, although diverse in focus, all highlight the complex interdependencies of the human and more-than-human world, and by unpacking binaries such as human/nature, nature/culture, subject/object and de-centring the human expose the complexities of an entangled human-nature relation that are shaping our understanding of sustainability. These messy relations challenge the well-versed mantras of anthropocentric exceptionalism in sustainability and sustainability education and offer new questions rather than answers for researchers, educators, and practitioners to explore. As working with new theoretical lenses is not always easy, this book also highlights the authors’ methods for approaching these ideas and imaginings.
