Massive changes are taking place all over the world in redefining the relationship between government, public, and private institutions. Nowhere is this redefinition more urgent than in communications, where widespread privatization and deregulation of telecommunication companies and broadcasters has created a need for new modes of corporate governance in the new global marketplace. In this study, Wolfgang Schulz and Thorsten Held set out to find answers to key questions relating to the changing role of government--especially in regulating the transnational communications industry--and to provide a tool kit for what they call regulated self-regulation applicable across the world.
This publication is based on the discussions of a workshop organised by the European Audiovisual Observatory in September 2002, in collaboration with the Institute of European Media Law and the Institute for Information Law. It examines co-regulation as an alternative to traditional forms of media regulation (parliamentary acts, EU directives etc) in Europe, current examples of its use and possible areas of application, characteristics and legal requirements, benefits and risks associated with it. Topics discussed include: a comparison of co-regulation systems in relation to self-monitoring and self-regulation regimes, protection of human dignity, distribution of racist content, technical standards, the EU legal and policy framework, the Council of Europe approach, the implementation and enforcement of co-regulation codes in a transfrontier context, example texts for self-regulation and co-regulation in advertising, youth protection, hate speech, the independence of journalists and technical standards.

From the mid-1990s onwards concerns regarding the exposure of children to harmful content in the increasingly digital media environment intensified. Soon thereafter policy makers across Europe realised that alternative regulatory instruments, such as self- and co-regulation, might be more appropriate than traditional legislation to address this matter of public interest. Taking the complex and delicate nature of protecting minors into account, this book provides an in-depth legal analysis of the alternative regulatory instruments that can be used to regulate content in the digital era, with particular attention to the protection of fundamental rights, such as freedom of expression, privacy and procedural guarantees, internal market regulation, competition rules, and implementation requirements.
Chris Marsden argues that co-regulation is the defining feature of the Internet in Europe. Co-regulation offers the state a route back into questions of legitimacy, governance and human rights, thereby opening up more interesting conversations than a static no-regulation versus state regulation binary choice.
