A landmark in the development of modern jurisprudence, the pure theory of law defines law as a system of coercive norms created by the state that rests on the validity of a generally accepted Grundnorm, or basic norm, such as the supremacy of the Constitution. Entirely self-supporting, it rejects any concept derived from metaphysics, politics, ethics, sociology, or the natural sciences. Beginning with the medieval reception of Roman law, traditional jurisprudence has maintained a dual system of "subjective" law (the rights of a person) and "objective" law (the system of norms). Throughout history this dualism has been a useful tool for putting the law in the service of politics, especially by rulers or dominant political parties. The pure theory of law destroys this dualism by replacing it with a unitary system of objective positive law that is insulated from political manipulation. Possibly the most influential jurisprudent of the twentieth century, Hans Kelsen [1881-1973] was legal adviser to Austria's last emperor and its first republican government, the founder and permanent advisor of the Supreme Constitutional Court of Austria, and the author of Austria's Constitution, which was enacted in 1920, abolished during the Anschluss, and restored in 1945. The author of more than forty books on law and legal philosophy, he is best known for this work and General Theory of Law and State. Also active as a teacher in Europe and the United States, he was Dean of the Law Faculty of the University of Vienna and taught at the universities of Cologne and Prague, the Institute of International Studies in Geneva, Harvard, Wellesley, the University of California at Berkeley, and the Naval War College. During the last few centuries, a practical dichotomy between God and humans has developed within moral theory. As a result, moral theory tends to focus only on humans where human autonomy is foundational or only on God where divine commands capriciously rule. However, the moral theology of Thomas Aquinas overcomes this dichotomy. For Thomas, humans reach their perfection by participating in God's wisdom and love. Perfecting Human Actions explores the ways humans participate in eternal law--God's wisdom that guides and moves all things to their proper action. The book begins with a thoughtful examination of the philosophic recovery of the notion of participation in Thomistic metaphysics. It then explains Thomas's theological understanding of the notion of participation to show how humans are related to God. It is discovered that when performing human actions, humans participate in the eternal law in two ways: as moved and governed by it, and cognitively. In reference to participation as moved and governed, humans are directed by God to their proper end of eternal happiness. This mode of participation can be increased by perfecting the natural inclinations through virtue, grace, and the gifts of the Holy Spirit. In reference to cognitive participation, humans as rational creatures can know their proper end and how to attain it. Through this knowledge of moral truths, the intellect participates in the eternal law. Cognitive participation is perfected by the intellectual virtues (especially faith) and the gifts of the Holy Spirit (especially wisdom). The book concludes by showing how the notion of human participation in the eternal law is a much better foundation for moral theory than the contemporary notion of autonomy. Western culture has been moving away from its Christian roots for several centuries but the turn from Christianity accelerated in the 20th century. At the core of this decline is a loss of a sense of our own transcendence. Scientific materialism has so seriously impacted our belief in human transcendence that many people find it difficult to believe in God and the human soul. This anti-transcendent perspective has not only cast its spell on the natural sciences, psychology, philosophy, and literature, it has also negatively impacted popular culture through the writings of Richard Dawkins, Daniel Dennett, and many others. The warning signs of this loss of transcendence have been expressed by thinkers as diverse as Carl Jung (psychiatrist), Mircea Eliade (historian of religion), Gabriel Marcel (philosopher), C.S. Lewis and J.R.R. Tolkien. These warnings were validated by a 2004 study in the American Journal of Psychiatry which showed that the absence of religion alone was responsible for a marked increase in suicide rates, sense of meaningless, substance abuse, separation from family, and other psychiatric problems. Thus, the loss of transcendence is negatively affecting not only individuals’ sense of happiness, dignity, ideals, virtues, and destiny, but also the culture. Ironically, the evidence for transcendence is greater today than in any other period in history. The problem is – this evidence has not been compiled and propagated. Fr. Spitzer’s book provides a bright light in the midst of this cultural darkness by presenting both traditional and contemporary evidence for God and a transphysical soul from several major sources. He also shows how human consciousness and intelligence is completely special – and cannot be replicated by artificial intelligence or animal consciousness. This study ponders different ways Christian thinkers understood humanity in its relationship to divine grace. It names fallacies that have in the past skewed theological understanding of that relationship. It argues that the philosophy of Charles Sanders Peirce avoided those same fallacies and provides a novel frame of reference for rethinking the theology of grace. The author shows how the insights of other American philosophers flesh out undeveloped aspects of PeirceÕs thought. He formulates a metaphysics of experience derived from his philosophical analysis. Finally, he develops an understanding of supernatural grace as the transmutation and transvaluation of human experience.
