Ship Sale and Purchase is an essential working guide for anyone involved in the business of making ship sale contracts and also in the resolution of related disputes. It continues to be of great practical use, highlighting typical problems and tensions between the parties to ship sale contracts, as well as best practice. This sixth edition contains a clause-by-clause commentary on SALEFORM 2012, the latest edition of the highly successful Memorandum of Agreement for the Sale and Purchase of Ships, issued by BIMCO and the Norwegian Shipbrokers Association. Key differences with the previous SALEFORM are described in order to help all involved get up to speed. Recent case law is evaluated to highlight contractual issues that have arisen in recent years and a comprehensive description of the many ways in which the standard form provisions may be modified to suit the particular requirements of each transaction. It provides complete coverage on the subject by including a practical overview of two other ship sale contracts, the current (1999) edition of Nipponsale and the first edition (2011) of the Singapore Ship Sale Form.
Purchasing and Supply Management includes the latest management, procurement, and negotiation techniques and the authors have taken great care to integrate the impact of global commerce on the buyers job. Historically, purchasing evolved as a weak part of manufacturing, gained its independence, and expanded to a financial contributer to a company's success. A major challenge of the buying job is to manage supply management. To do this, the buyer must know and use the full range of techniques and procedures available to the true professional. This book is dedicated to these functions of supply and all they entail.
INTRODUCTION All of my life, I have wondered why some people are leaders and others are not. This book is sort of an analysis of the relationship between employee, supervisor, manager and leader. In the 1970's, I had the pleasure of working out of a Pan Am training department office at JFK airport, NY, with a fellow who I "observed" as having qualities of leadership. I often thought had he been an officer in the trenches, and called "let's go", his men, without hesitation, would follow him "over the top". He was in management at Pan Am as a Maintenance Technical Instructor. I was conducting classes in management development. Of course, he wasn't a CEO or Vice President, probably because he did not have the necessary formal education, but to me he represented the qualities I would hope to find in those positions. He planned his work, set goals and clearly communicated them to individuals or groups. He comfortably reflected a style of knowledgeable, but modest, self confidence. With a pleasant personality, he seemed to earn the trust of others. It was always evident he had prepared himself through experience and study of the subject he was teaching. I don't know why, but to me, as I saw him perform his work, he was the natural "leader" 14 JOHN STEARNS type. Even though there were several other well qualified instructors in the group, this instructor, John Romaine, came to mind as I prepared to write this book on the subject of leadership in management. I am aware of the many books, courses, and other materials on the subject of management, and I have read many of them, but I believe in using my personal experiences and observations, with the experience of others, it will make clear the difference between "managers" and those who are "leaders in management". MY OBSERVATIONS OF, AND EXPERIENCES WITH LEADERSHIP IN MANAGEMENT 15 It is not my intention to write this as a "personal career" story and therefore, references to my personal experiences are only to be considered as they relate to the subject and not necessarily in chronological order. In writing this book I am motivated by three thoughts— First—most of my life I have mentally noted the differences in styles, manners, and methods of peoples' relationships with others. and then I found that in my working experience I had several opportunities to highlight and explore those items. Secondly—In recent years, the emphasis on selecting leaders has grown. It seems that everyone is always seeking a good leader—tribes, organizations, companies and countries, and too often, when one is selected there follows disappointment. And thirdly, it is helpful to recall the pleasure of working with men and women who were instrumental in accomplishing much that contributed to our society. 16 JOHN STEARNS It is also a recognized fact that there are many in management positions that have made and/ or are making great differences in the lives of people. So in this book instances will be noted in which men and women represent the various styles and manners of leadership in management and make note of the qualities that make some more leaders than others. This book is written as an "observation", with the hope it might encourage people holding management positions to reflect on their style and methods of communicating with others. Opening conclusions: (1) many organizations, with good purpose and intention, find themselves managed so poorly that others live at a disadvantage and unhappiness. (2) in too many instances large companies have had such poor management that millions of people have been hurt financially and otherwise and (3) in many countries on all continents, people find themselves searching for good leaders and when they don't, the results are friction and in many instances, bloodshed. So, my question is, what is it about management and leadership that is so difficult for some men and women to accept and practice? What is the difference between a Manager and a Leader?
Buying into Change examines how the development of a mass consumer society under the dictatorship of General Francisco Franco (1939–1975) inserted Spain into transnational consumer networks and set the stage for Spain’s transition to democracy during the late 1970s. This transition is broadly significant to both a Spanish public still struggling to redefine their society after Franco and to scholars who have long debated the origins of Spain’s current democracy, yet many aspects of it remain largely unexamined. Buying into Change incorporates mass consumption into our understanding of Spain’s democratic transition by tracing the spread and social impact of new foreign-influenced department stores, of imported innovations such as modern mass advertising, and of consumer magazines that promoted foreign products. Initially, these enterprises backed Franco’s conservative policies, and the regime in turn encouraged consumption in order to improve its image both domestically and abroad. Spain’s new globally oriented commerce ultimately sold retailers and shoppers not just foreign ways of buying and selling but also subversive ideas. Imported 1960s fashions brought along countercultural notions on issues such as gender equality. And as Spaniards consumed more like their foreign neighbors, they increasingly viewed themselves as cosmopolitan and European and identified with liberal political conditions abroad, undermining Francoism’s doctrine of national exceptionalism, thus laying the social foundations for democratization and European integration in Franco’s wake.
Abandoned housing projects is one the major problems in housing industry in Peninsular Malaysia. The reasons leading to this problem are many. This catastrophe has caused multifarious problems to the stakeholders, particularly the purchasers who become the aggrieved parties. To date, there is no effective and once-and-for-all means to face the problems of abandoned housing projects. One of the factors which causes abandonment of housing projects in Peninsular Malaysia, is the lack of political will on part of the government to adopt an affirmative better housing delivery system such as the ‘full build then sell system’ and the introduction of a housing development insurance to face the problems of housing abandonment. This book provides in-depth analyses of the terms and conditions of the statutory standard sale and purchase agreements as enshrined in Schedules G, H, I and J of the Housing Development (Control and Licensing) Regulations 1989. The objective of this book, among others, is to identify the weaknesses of the terms of the agreements, if any, which may have contributed to the problem of abandoned housing projects and their consequential troubles. As comparative analyses, the terms and conditions of the sale and purchase agreements as applicable and enforced in the Republic of Singapore and New South Wales, Australia, are chosen. The purpose of these comparative analyses is to find the terms and conditions in these foreign jurisdictions’ agreements which can be learned and adopted in the statutory standard sale and purchase agreements (Schedules G, H, I and J). It is also for the betterment of the Malaysian housing industry as a whole, and to protect the interests of the stakeholders, in particular the purchasers as against the problems of housing abandonment and its consequences.
