Extraordinary, therefore, it is, that while the digests of decided cases relating to every branch of the law are so numerous and so elaborately compiled, no complete systematic analysis has as yet been attempted of the first principles of law. In reality, however, the great attention at present paid to the records of cases determined by our courts only renders an inquiry into elementary principles the more essential.
