Le nouveau droit de la protection de l'enfant et de l'adulte, qui est entré en vigueur le 1er janvier 2013, est venu remplacer et moderniser l'ancien droit de la tutelle, qui datait de 1907. Les nouvelles dispositions et l'institution de l'autorité de protection de l'enfant et l'adulte (APEA) ont depuis parfois fait l'objet de vives critiques, ce qui a amené le Parlement à transmettre au Conseil fédéral quatre postulats le priant d'examiner plusieurs questions en rapport avec le nouveau droit et de rédiger un rapport à ce sujet. Dès le printemps 2016, le Conseil fédéral a, par ailleurs, laissé entrevoir que d'autres questions ayant trait à la nouvelle réglementation y seraient également traitées. Il ne s'agit cependant pas ici d'une évaluation globale du nouveau droit. Le Conseil fédéral estime en effet qu'une telle évaluation serait, à ce stade, prématurée. Le présent rapport se borne donc à traiter les questions soulevées dans les postulats susmentionnés et à débattre de certaines questions auxquelles on est aujourd'hui en mesure d'apporter des réponses.
