The familiar story of civil rights goes like this: once, America’s legal system shut Black people out and refused to recognize their rights, their basic human dignity, or even their very lives. When lynch mobs gathered, police and judges often closed their eyes, if they didn’t join in. For Black people, law was a hostile, fearsome power to be avoided whenever possible. Then, starting in the 1940s, a few brave lawyers ventured south, bent on changing the law. Soon, ordinary African Americans, awakened by Supreme Court victories and galvanized by racial justice activists, launched the civil rights movement. In Before the Movement, acclaimed historian Dylan C. Penningroth brilliantly revises the conventional story. Drawing on long-forgotten sources found in the basements of county courthouses across the nation, Penningroth reveals that African Americans, far from being ignorant about law until the middle of the twentieth century, have thought about, talked about, and used it going as far back as even the era of slavery. They dealt constantly with the laws of property, contract, inheritance, marriage and divorce, of associations (like churches and businesses and activist groups), and more. By exercising these “rights of everyday use,” Penningroth demonstrates, they made Black rights seem unremarkable. And in innumerable subtle ways, they helped shape the law itself—the laws all of us live under today. Penningroth’s narrative, which stretches from the last decades of slavery to the 1970s, partly traces the history of his own family. Challenging accepted understandings of Black history framed by relations with white people, he puts Black people at the center of the story—their loves and anger and loneliness, their efforts to stay afloat, their mistakes and embarrassments, their fights, their ideas, their hopes and disappointments, in all their messy humanness. Before the Movement is an account of Black legal lives that looks beyond the Constitution and the criminal justice system to recover a rich, broader vision of Black life—a vision allied with, yet distinct from, “the freedom struggle.”

An Old Creed for the New South:Proslavery Ideology and Historiography, 1865–1918 details the slavery debate from the Civil War through World War I. Award-winning historian John David Smith argues that African American slavery remained a salient metaphor for how Americans interpreted contemporary race relations decades after the Civil War. Smith draws extensively on postwar articles, books, diaries, manuscripts, newspapers, and speeches to counter the belief that debates over slavery ended with emancipation. After the Civil War, Americans in both the North and the South continued to debate slavery’s merits as a labor, legal, and educational system and as a mode of racial control. The study details how white Southerners continued to tout slavery as beneficial for both races long after Confederate defeat. During Reconstruction and after Redemption, Southerners continued to refine proslavery ideas while subjecting blacks to new legal, extralegal, and social controls. An Old Creed for the New South links pre– and post–Civil War racial thought, showing historical continuity, and treats the Black Codes and the Jim Crow laws in new ways, connecting these important racial and legal themes to intellectual and social history. Although many blacks and some whites denounced slavery as the source of the contemporary “Negro problem,” most whites, including late nineteenth-century historians, championed a “new” proslavery argument. The study also traces how historian Ulrich B. Phillips and Progressive Era scholars looked at slavery as a golden age of American race relations and shows how a broad range of African Americans, including Booker T. Washington and W. E. B. Du Bois, responded to the proslavery argument. Such ideas, Smith posits, provided a powerful racial creed for the New South. This examination of black slavery in the American public mind—which includes the arguments of former slaves, slaveholders, Freedmen's Bureau agents, novelists, and essayists—demonstrates that proslavery ideology dominated racial thought among white southerners, and most white northerners, in the five decades following the Civil War.
Slaveholders were preoccupied with presenting slavery as a benign, paternalistic institution in which the planter took care of his family and slaves were content with their fate. In this book, Eugene D. Genovese and Elizabeth Fox-Genovese discuss how slaveholders perpetuated and rationalized this romanticized version of life on the plantation. Slaveholders' paternalism had little to do with ostensible benevolence, kindness and good cheer. It grew out of the necessity to discipline and morally justify a system of exploitation. At the same time, this book also advocates the examination of masters' relations with white plantation laborers and servants - a largely unstudied subject. Southerners drew on the work of British and European socialists to conclude that all labor, white and black, suffered de facto slavery, and they championed the South's 'Christian slavery' as the most humane and compassionate of social systems, ancient and modern.
