Desde épocas antiguas se rechaza socialmente el plagio porque supone un engaño sobre la verdadera autoría de una obra del ingenio. Además, no solo vulnera los derechos de los creadores originales, sino que ataca a la libertad de creación o producción literaria, artística y científica, que repre­senta un valor cultural y está reconocida como un derecho fundamental en nuestro ordenamiento jurídico. En nuestros días, la lucha contra el plagio se proyecta en dos direcciones. Por una parte, se centra en la defensa de las facultades reconocidas a los autores e intérpretes; es decir, en la tutela clásica de la propiedad intelectual. Por otra, dado que las nuevas tecnologías facilitan la copia o reproducción ilegal de trabajos científicos, ha surgido la necesidad de incrementar la lucha contra el plagio para preservar la excelencia académica. Pero, pese a la repulsa social generalizada, no es fácil precisar una noción de plagio que resulte unánimemente aceptada. De un lado, por la dificultad de definir los límites de lo lícito e ilícito en esta materia y, de otro, por las múltiples modalidades de plagio que pueden presentarse en la práctica. El autor analiza y define los perfiles de este instituto, con aportacio­nes doctrinales y jurisprudenciales, para poder determinar con precisión las posibles conductas plagiarias y los remedios procesales arbitrados para combatir estas acciones ilícitas.

Enforced disappearance is one of the most serious human rights violations. It constitutes an autonomous offence and a crime under international law on account of its multiple and continuing character. It is not a phenomenon of the past, nor is it geographically limited to Latin America: such scourge is widespread today and on the increase in other continents. For more than twenty-five years, relatives of disappeared people worldwide have insisted on the pressing need for an international legally binding instrument against enforced disappearances. 2006 is the year of the adoption of the International Convention on the Protection of All Persons from Enforced Disappearances, which represents the result of several legislative and jurisprudential developments that are duly analyzed in this book. The Convention has been opened for signature in February 2007.
