Norms beyond Empire seeks to rethink the relationship between law and empire by emphasizing the role of local normative production. While European imperialism is often viewed as being able to shape colonial law and government to its image, this volume argues that early modern empires could never monolithically control how these processes unfolded. Examining the Iberian empires in Asia, it seeks to look at norms as a means of escaping the often too narrow concept of law and look beyond empire to highlight the ways in which law-making and local normativities frequently acted beyond colonial rule. The ten chapters explore normative production from this perspective by focusing on case studies from China, India, Japan, and the Philippines. Beyond Empires explores the complexity of empire building from the point of view of self-organized networks, rather than from the point of view of the central state. This focus takes readers into a world of cooperative strategies worldwide that emphasises the role played by individuals, rather than institutions, in the overseas expansion and consequent development of European empires. While unveiling the practices and mechanisms of cooperation between individuals, this volume show cases the role played by individuals for the creation, development and maintenance of self-organized networks in the Early Modern period. Applying new conceptual and theoretical inputs, this book values the contributions of different ‘worlds’, bringing to the fore the interactions of Europeans and non-Europeans, Christians and non-Christians, people living within-, on- or just outside the border of empire.
The impact of nationalism on the emergence and development of African literature is now well documented. Globalization or the postnational state it seems to herald, the emblematic phenomenon of our era, has not received much attention. Using a cultural studies approach, Beyond Empire and Nation is a fascinating account of the process of globalization in African Literature. The book starts with an analysis of nationalist rhetoric and ideology as exemplified by works such as Things Fall Apart. Thereafter, it dedicates a chapter each to B. Kojo Laing's novels and Nuruddin Farah's Trilogy (Maps, Gifts, and Secrets) as articulations of a globalized, postnational reality. At the heart o the book is an analysis of a nuanced and complex experience of global modernity as Africans reassess the constants of nationalist discourse: culture, identity, locality, and territoriality. Ngaboh-Smart does not believe that the postnational phenomenon is necessarily detrimental to the national-state and argues that it may well be capable of generating a new form of individual agency, although he is critical of those writers who ignore the new power dynamic inherent in globalization. Moving beyond the “clash of cultures” paradigm, Ngaboh-Smart's account of the renegotiation of national identity and ideology is a significant contribution to the criticism of African literature and its link to global social processes.
This collection brings together research on linguistic prescriptivism and social identities, in specific contemporary and historical contexts of cross-cultural contact and awareness. Providing multilingual and multidisciplinary perspectives from language studies, lexicography, literature, and cultural studies, our contributors relate language norms to frameworks of identity beyond monolingual citizenship - nativeness, ethnicity, politics, religion, empire. Some chapters focus on traditional instruments of prescriptivism: language academies in Europe; government language planners in southeast Asia; dictionaries and grammars from Early Modern and imperial Britain, republican America, the postcolonial Caribbean, and modern Germany. Other chapters consider the roles of scholars in prescriptivism, as well as the more informal and populist mechanisms of enforcement expressed in newspapers. With a thematic introduction articulating links between its breadth of perspectives, this accessible book should engage everyone concerned with language norms.
This collection brings together an international group of scholars in order to provide new insights into the diversity of imperial legalities. Across empires, legalities were produced not just – or even – through the imperial imposition of laws and legal forms, but through local processes of negotiation and contestation. Far from the metropoles, local actors found ways to creatively navigate and subvert imperial frameworks and laws and to create space in which to shape new legalities, responsive to local circumstance and need. Covering topics as diverse as smuggling in eighteenth century Jersey, the criminalisation of female market women in World War II-era southern Nigeria, and whiteness and race in ‘sexual perversion’ cases in twentieth-century Malaya, the collection elaborates new legal histories of empire. Drawing from Britain, Ireland, Australia, Canada, the USA, India, Sri Lanka, Africa and Malaysia, the collection brings together chapters that examine the stories of the peoples of empires and shows how they constituted, experienced, navigated and subverted the legal complexities of living under empire. This book will be of interest to scholars and researchers in law and history, but also to those with relevant interests in post-colonial and cultural studies, as well as in criminology and sociology.
New research methods allow us to explore how relics of the material culture of the medieval north can confront, corroborate, or disprove the depiction of social norms in the Old Norse-Icelandic literary corpus, which remains the most important source of our present-day knowledge of social development in the Viking Age and medieval Scandinavia. This interdisciplinary volume considers in depth how social values such as reputation, honour, and friendship, were integral to the development of rituals, customs, religion, literature, and language in the medieval North.
Harmony has become a major challenge for modern governance in the twenty-first century because of the multi-religious, multi-racial and multi-ethnic character of our increasingly globalized societies. Governments all over the world are facing growing pressure to integrate the many diverse elements and subcultures which make up modern pluralistic societies. This book examines the idea of harmony, and its place in politics and governance, both in theory and practice, in Asia, the West and elsewhere. It explores and analyses the meanings, mechanisms, dimensions and methodologies of harmony as a normative political ideal in both Western and Asian philosophical traditions. The book argues that in Western political thought - which sees politics as primarily concerned with resolving social conflicts and protecting individual rights - the concept of harmony has often been neglected. In contrast, since earliest times harmony or ‘he’ has been a profound theme in Confucian thought, and current leaders of many East Asian governments, and the Chinese government, have explicitly declared that the realisation of a harmonious society is their aim. The book also assesses how harmony is pursued, jeopardized or deformed in the real world of politics, based upon empirical analysis of a variety of different cultural, social and political contexts, including: China, Hong Kong, Singapore, Malaysia, Singapore, Vietnam, Denmark, Latin America and the Scandinavian countries. It shows how harmony as an organizing concept can help to promote new thinking in governance, and overcome problems of modern-day governance like distrust, adversarial conflicts, hyper-individualism, coercive state intervention, and free-market alienation. It also discusses the potential problems posed by the pursuit of harmony, in particular in the grave threat of totalitarianism, and considers how these risks could best be mitigated.
Examining diversity as a fundamental reality of empire, this book explores European colonial empires, both terrestrial and maritime, to show how they addressed the questions of how to manage diversity. These questions range from the local to the supra-regional, and from the management of people to that of political and judicial systems. Taking an intersectional approach incorporating categories such as race, religion, subjecthood, and social and legal status, the contributions of the volume show how old and new modes of creating social difference took shape in an increasingly globalized early modern world, and what contemporary legacies these ‘diversity formations’ left behind. This volume shows diversity and imperial projects to be both contentious and mutually constitutive: on the one hand, the conditions of empire created divisions between people through official categorizations (such as racial classifications and designations of subjecthood) and through discriminately applied extractive policies, from taxation to slavery. On the other hand, imperial subjects, communities, and polities within and adjacent to the empire asserted themselves through a diverse range of affiliations and identities that challenged any notion of a unilateral, universal imperial authority. This book highlights the multidimensionality and interconnectedness of diversity in imperial settings and will be useful reading to students and scholars of the history of colonial empires, global history, and race.
