This open access book presents twelve unique studies on mediation from researchers in Denmark, Finland, Norway and Sweden, respectively. Each study highlights important aspects of mediation, including the role of children in family mediation, the evolution and ambivalent application of restorative justice in the Nordic countries, the confusion of roles in court-connected mediation, and the challenges in dispute systems. Over the past 20-30 years, mediation has gained in popularity in many countries around the world and is often heralded as a suitable and cost-effective mode of conflict resolution. However, as the studies in this volumes show, mediation also has a number of potential drawbacks. Parties’ self-determination may be jeopardized, affected third parties are involved in an inadequate way, and the legal regulations may be flawed. The publication can inspire research, help professionals and policymakers in the field and be used as a textbook.
For a long time, the Nordic countries have been a region of peace, with the ability to resolve conflicts peacefully among themselves, and a region for peace, actively promoting peace globally. Although efforts to actively brand the Nordic region are ongoing, the Nordic Peace brand is an area with untapped potential. The Nordics have rich traditions for working together on peace and conflict resolution. These joint efforts have grown organically and informally from like-mindedness, letting the common Nordic culture and ways of working foster integration among them where relevant. The people working in the Nordic countries on Nordic cooperation and peace recognize the potential of strengthening the Nordic Peace brand. One area of special potential is increasing focus on the shared Nordic priorities of prevention and the women, peace and security agenda as part of the Nordic Peace brand.
This open access book examines whether a distinctly Nordic procedural or court culture exists and what the hallmarks of that culture are. Do Nordic courts and court proceedings share a distinct set of ideas and values that in combination constitute the core of a regional legal culture? How do Europeanisation, privatisation, diversification and digitisation influence courts and court proceedings in the Nordic countries? The book traces the genesis and formation of Nordic courts and justice systems to provide a richer comprehension of contemporary Nordic legal culture, and an understanding of the relationship between legal cultural stability and change. In answering these questions, the book provides models for conceptualising procedural culture. Nordic procedural culture has partly developed organically and is partly also the product of deliberate efforts to maintain a certain level of alignment between the Nordic countries. Studying Nordic cooperation enables us to gain a deeper understanding of current regional, European and global harmonisation processes within procedural law. The influx of supranational European law, increased use of alternative dispute resolution and growth in regulation density that produces a conflict between specialisation and coherence, have tangible impact on the role of courts in a democratic society, the form of court proceedings and court structures. This book examines whether and why some trends exert more tangible, or perhaps simply more perceptible, influence on procedural culture than others.
This book offers an analysis of the current trends and developments in Nordic civil litigation and is divided into four main parts. In the first part a picture of the current civil litigation landscape is provided by focusing on whether there is a truly Nordic form of civil litigation, the current state of Nordic civil litigation, the recent major reforms of civil procedure legislation and the effects of Europeanization. In the second part, the way rules on court-connected mediation have been implemented and practiced in the Nordic countries is discussed. The authors offer their insights on why court-connected mediation has not been fully embraced by Nordic lawyers and the Nordic approach to this type of mediation is contrasted with the Austrian and German approaches. In the third part, recent developments affecting access to justice in the Nordic countries are discussed. Among the topics are changes in legal aid schemes, the impact of recent civil procedure law reforms, hindrances for larger companies to use litigation as a method of dispute resolution and differences in costs and delays. Additionally, Alternative Dispute Resolution and Class or Group Actions are explored as methods to enhance access to justice. The potential adverse effects of Alternative Dispute Resolution and Group Actions are also examined, both in a Nordic and European context. In the final part, conclusions are drawn from both historical and future-oriented perspectives.

Exploring mediation and related practices of conflict regulation, this book takes an interdisciplinary approach that includes historical, legal, anthropological and international perspectives. Many contemporary environmental risks and global environmental changes occurring today are unprecedented in the history of human life on earth. However, the images and narratives through which humans relate to these phenomena are built on existing cultural tropes and narrative models. Cultural, social, and historical contexts strongly influence how we construct images and narratives of nature and the environment. It is therefore highly important to study such narratives in works of literature, film, and other forms of cultural expression in relation to the specific circumstances from which they arise. Nordic Narratives of Nature and the Environment is the first English language anthology that presents ecocritical research on northern European literatures and cultures. The contributors examine specifically Nordic narratives of nature and the environment, with a focus on the cultures and literatures of the modern northern European countries Denmark, Finland, Norway, and Sweden, including Sápmi, which is the land traditionally inhabited by the indigenous Sami people. Covering northern European literatures and cultures over a period of more than two centuries, this anthology provides substantial insights into both old and new narratives of nature and the environment as well as intertextual relations, the variety of cultural traditions, and current discourses connected to the Nordic environmental imagination. Case studies relating to works of literature, film, and other media shed new light on the role of culture, history and society in the formation of narratives of nature and the environment, and offer a comprehensive and multi-faceted overview of the most recent ecocritical research in Scandinavian studies.
Does the Nordic model of education still stand by its original principles and safeguard education for all? This Open Access volume is a carefully crafted collection of chapters that investigate the different aspects of equity, equality and diversity across the education systems in the Nordic countries. Based on data from various national and international large-scale assessments, the volume provides a better understanding of both the functions and foundations of the Nordic model, along with how the concepts mentioned above are enacted in practice. Across the chapters, data from different national and international large-scale assessment studies are used for cross- and single-country analyses on a variety of issues related to equity, equality and inequality in diverse educational settings. The investigations address different subject domains (i.e., mathematics, science, reading), age and grade groups, but also issues related to teachers and the schools themselves. In addition to these empirical chapters, the book addresses the theoretical and methodological underpinnings of the ideas and tools embedded in the phenomena of equity and equality and how they have met in the Nordic model of education.

Qualitative analyses of young children’s learning in natural settings are rare, so this new book will make educators sit up and pay attention. It lays out a Nordic, or continental European teaching and learning paradigm whose didactic framework is distinct from the Anglo-American system. This analysis, which features contributions and case studies from researchers in a range of subjects, is built on principles such as the learner’s perspective, establishing sufficient intersubjectivity, ‘pointing out’, and informing experience linguistically. After clarifying some historical background, the book discusses the contemporary emphasis in early childhood education on pedagogy/learning. What should ‘didactics’ mean in educating young children? The book examines the opportunities for learning that teachers provide for children in early childhood education, as well as how children respond to these opportunities. It presents empirical studies from a variety of naturalistic settings, including mathematics, making visual art, ecology, music, dance, literacy and story-telling, as well as learning about gender, morality and democracy. The authors seek to answer key questions about the processes involved in both teaching and learning. What challenges do teachers face as they try to expand children’s knowledge in various fields of learning? How do they respond to these challenges, and what can we learn about children’s corresponding uptake? What now requires further research? One key distinction in researching children’s learning is between studies that look at ‘process’ and those that analyze ‘product’. In the tradition of Piaget, Vygotsky and Werner, as well as Mercer and Valsiner’s more recent work, this book advocates the importance and relative rareness of the former type of study.
