The Making of Felony Procedure in Middle English Literature explores the literary inheritance of criminal procedure in thirteenth to fifteenth century English law, focusing on felony, the gravest common law offense. Most scholarship in medieval law and literature has focused on statute and theory, drawing from the instantiating texts of English law: acts of Parliament, judicial treatises, the Magna Carta. But those whose job it was to write about the law rarely wrote about felony. Its definition was left to its practice--from investigation to conviction--and that procedure fell to local communities who were generally untrained in the law. Left with many practical and ethical questions and few legal answers, they turned to cultural ones, archived in sermons they had heard, plays they had seen, and poetry they knew. This book reads the documents of criminal procedure--coroners' reports, plea rolls, and gaol delivery records--alongside literary scenes of investigation, interrogation, and witnessing to tell a new intellectual history of criminal procedure's beginnings. The chapters of The Making of Felony Procedure guide the reader through the steps of a felony prosecution, from act to conviction, examining the questions local communities faced at each step. What evidence should be prioritized in a death investigation? Should the accused consider narrative satisfaction when building his plea? What are the dangers of a witnessing system that depends so heavily on a few "oathworthy" men? What can a jury do if the accused's guilt seems partial or complex? The reappearance of alliterative verse in the fourteenth and fifteenth centuries remains one of the most puzzling issues in the literary history of medieval England. In From Lawmen to Plowmen, Stephen M. Yeager offers a fresh, insightful explanation for the alliterative structure of William Langland’s Piers Plowman and the flourishing of alliterative verse satires in late medieval England by observing the similarities between these satires and the legal-homiletical literature of the Anglo-Saxon era. Unlike Old English alliterative poetry, Anglo-Saxon legal texts and documents continued to be studied long after the Norman Conquest. By comparing Anglo-Saxon charters, sermons, and law codes with Langland’s Piers Plowman and similar poems, Yeager demonstrates that this legal and homiletical literature had an influential afterlife in the fourteenth-century poetry of William Langland and his imitators. His conclusions establish a new genealogy for medieval England’s vernacular literary tradition and offer a new way of approaching one of Middle English’s literary classics.
The late medieval Church obliged all Christians to rebuke the sins of others, especially those who had power to discipline in Church and State: priests, confessors, bishops, judges, the Pope. This practice, in which the injured party had to confront the wrong-doer directly and privately, was known as fraternal correction. Edwin Craun examines how pastoral writing instructed Christians to make this corrective process effective by avoiding slander, insult, and hypocrisy. He explores how John Wyclif and his followers expanded this established practice to authorize their own polemics against mendicants and clerical wealth. In this book the distinguished medievalist Lynn Staley turns her attention to one of the most dramatic periods in English history, the reign of Richard II, as seen through a range of texts including literary, political, chronicle, and pictorial. Richard II, who ruled from 1377 to 1399, succeeded to the throne as a child after the fifty-year reign of Edward III, and found himself beset throughout his reign by military, political, religious, economic, and social problems that would have tried even the most skilled of statesmen. I n Languages of Power in the Age of Richard II Staley does not so much "read" literature through history as offer a way of "reading" history through its refractions in literature. In essence, the text both isolates and traces what is an actual search for a language of power during the reign of Richard II and scrutinizes the ways in which Chaucer and other courtly writers participated in these attempts to articulate the concept of princely power. As one who took it upon himself to comment on the various means by which history is made, Chaucer emerges from Staley's narrative as a poet without peer.
