Ten years have passed since the Mental Health Act (MHA) 2007 came into force in England. An amending statute, the Act reformed the MHA 1983 and reshaped the law governing the compulsory care and treatment of people suffering from mental disorders. Primarily driven by concerns about risk, it sought to remove legalistic obstacles to civil commitment and extend the law's coercive reach into the community. At the time of its introduction, the 2007 Act was written off as a retrograde step and a missed opportunity for radical, rights-focused reform. Despite this, little attention has been paid to its impact in the years since. Published to coincide with the tenth anniversary of the 2007 Act, this book offers a timely evaluation of mental health law and policy in England. It argues that the current MHA defies easy categorisation within any of the descriptive models which have customarily narrated the mechanics of civil commitment, namely 'legalism', 'new legalism', and 'medicalism'. It therefore makes the case for a new model – new medicalism – to account for the 2007 Act's enhancement of the discretion of mental health professionals for the express purposes of facilitating the management of situations of risk. In doing so, the book: critically examines the problems inherent in civil commitment frameworks organised around the concept of risk; explores the theoretical foundations of new medicalism; considers the challenges facing proponents of future reform in the era of the UN Convention on the Rights of Persons with Disabilities; and, reflects on the 2007 Act's practical impact.
Most historians portray 19th-century county asylums as the exclusive realm of the asylum doctor, but Bartlett (law, U. of Nottingham) argues that they should be thought of as an aspect of English poor law, in which the medical superintendent had remarkably little power. He examines the place of the county asylum movement in the midcentury poor law debates and its legal and administrative regimes. Taking the Leicestershire asylum as a case study, he explores the role of poor law officers in admission processes, and relations between them and the staff and inspectors.

Social Order/Mental Disorder represents a provocative and exciting exploration of social response to madness in England and the United States from the eighteenth through the twentieth centuries. Scull, who is well-known for his previous work in this area, examines a range of issues, including the changing social meanings of madness, the emergence and consolidation of the psychiatric profession, the often troubled relationship between psychiatry and the law, the linkages between sex and madness, and the constitution, character, and collapse of the asylum as our standard response to the problems posed by mental disorder. This book is emphatically not part of the venerable tradition of hagiography that has celebrated psychiatric history as a long struggle in which the steady application of rational-scientific principles has produced irregular but unmistakable evidence of progress toward humane treatments for the mentally ill. In fact, Scull contends that traditional mental hospitals, for much of their existence, resembled cemeteries for the still breathing, medical hubris having at times served to license dangerous, mutilating, even life-threatening experiments on the dead souls confined therein. He argues that only the sociologically blind would deny that psychiatrists are deeply involved in the definition and identification of what constitutes madness in our world – hence, claims that mental illness is a purely naturalistic category, somehow devoid of contamination by the social, are taken to be patently absurd. Scull points out, however, that the commitment to examine psychiatry and its ministrations with a critical eye by no means entails the romantic idea that the problems it deals with are purely the invention of the professional mind, or the Manichean notion that all psychiatric interventions are malevolent and ill-conceived. It is the task of unromantic criticism that is attempted in this book.

Professor Houston draws upon a wide range of contemporary sources, notably asylum documents, and civil and criminal court records, to present unique insights into the issues around madness, including the written and spoken words of sufferers themselves, and the vocabulary associated with insanity. The links between madness and a range of other issues are explored including madness, gender, social status, religion and witchcraft, in addition to the attributed causes of derangement such as heredity and alcohol abuse. This is a detailed yet profoundly humane and compassionate study of the everyday experiences of those suffering mental impairments ranging from idiocy to lunacy, and an exploration into the meaning of this for society in the eighteenth century.
This comparative study gathers together new research by local historians into aspects of welfare in Hertfordshire spanning four centuries and focusing on towns and villages across the county, including Ashwell, Cheshunt, Hertford, Pirton, and Royston, amongst many others. In so doing it makes a valuable contribution to the current debate about the spatial and chronological variation in the character of welfare regimes within single counties, let alone more widely. As well as viewing poor relief geographically and chronologically, the book also considers the treatment of particular groups such as the aged, the mad, children, and the unemployed, and shows how, within the constraints of the relevant welfare laws, each group was dealt with differently, giving a more nuanced picture than has perhaps been the case before. The overarching question that the book attempts to answer is how effectively Hertfordshire cared for those in need. With chapters on madhouses, workhouses, certified industrial schools, the Foundling Hospital, pensions, and medical care, the book covers a very broad range of topics through which a complex picture emerges. While some officials seem to have been driven by a relatively narrow sense of their obligations to the poor and vulnerable, others appear to have tailored welfare packages to their precise needs. Naturally, self-interest played a part: if the weakest citizens were well managed, vagrancy might be lessened, the spread of disease contained, and control maintained over the cost of looking after the poor and sick. It seems that Hertfordshire was relatively nimble and sensitive in discovering and treating its people's needs. Evidence is beginning to emerge, in other words, that Hertfordshire was in essence a caring county.
