As of October 2008, liner shipping companies lose their privileged status under EU competition law due to withdrawal of the liner conference block exemption, which generously authorized horizontal price-fixing and similar agreements between liner shipping companies. Where the liner consortia block exemption does not apply, all cooperative activity should be carefully and individually assessed under the competition provisions of the EC Treaty. Alla Pozdnakova has taken this opportunity to research and write an in-depth study of competition law problems in the liner shipping context. Her analysis is not only the first to examine the new European regime, and thus the most up-to-date study of the subject; it is in fact the first major independent study of how Articles 81 and 82 EC are construed and applied to the market conduct of liner shipping companies. In particular, the author addresses the following legal questions: * Does cooperation between liner shipping companies infringe Article 81(1) even if it does not entail hard-core restrictions of competition? * Can a cooperative arrangement between liner shipping companies claim that the efficiencies they produce outweigh the negative impact on competition (Article 81(3))? * When do certain market strategies of liner carriers become an abuse of a collective or individual dominant position (Article 82)? * Does parallel pricing behaviour infringe EC Treaty competition rules? Systematically, the author considers various market strategies of liner shipping companies and tests them as to their compatibility with EC Treaty competition provisions. In doing so, she thoroughly analyses European Commission decisions and judgments of the European courts, applying them authoritatively to the liner shipping sector. In this way, her book provides a well-structured account that clearly identifies the legal issues that liner shipping companies are likely to face once the special treatment traditionally allowed them is withdrawn. A summary of current and prospective developments in EU competition regulation and policy in liner shipping rounds up the analysis. Liner Shipping and EU Competition Law will be a unique and powerful resource for practitioners and policymakers as liner shipping companies restructure their agreements and market strategies to accommodate loss of the block exemption. It is also sure to become a definitive analysis of the legal identity of the liner shipping market sector under European competition law.
Governing Global Networks argues that most international regimes are grounded in states' mutual cooperation, and not in the dictates of the most powerful states. It focuses on the regimes for four important international industries - shipping, air transport, telecommunications and postal services. Of particular importance to these regimes have been states' interests in both the free flow of commerce and their policy autonomy. The authors examine the relationship between these potentially conflicting goals. In particular they trace the impact of deregulation, which has led some states increasingly to place gains from economic openness ahead of their desire to maintain a high degree of control of their own economies; and to the decline of the traditional cartel elements of these regimes. This analysis is an important contribution to theoretical debates between neo-realists and neo-liberals in the study of international organisations and international political economy.
The importance of international liner shipping needs little emphasizing. A large majority of international trade moves by sea, and the liner shipping share in total freight revenue exceeds one-half. Notwithstanding, people in general know surprisingly little about the basic facts of the liner shipping industry, and, in particular, about the economics ofliner shipping. Perhaps because it is an international industry, where shipping lines flying many different flags participate, it has tended to fall in between national accounts of domestic industries. Even transport economists have, generally speaking, treated liner shipping rather 'stepmotherly'; besides the work of Bennathan and Walters (1969), a relatively small group of specialized maritime economists, including A. Stromme-Svendsen, T. Thorburn, S. Sturmey, R. Goss, and B. M. Deakin, have in the post-war period made important contributions to the subject, but so far no coherent and reasonably comprehensive treatise of liner shipping economics has appeared. The first purpose of the present volume is therefore obvious: to provide just that. The book is divided in three parts: Part I The liner shipping industry; Part II Liner service optimization; Part III Economic evaluation of the conference system. Needless to say, all three parts concur to fulfill the first purpose of providing a complete book of liner shipping economics. In Part II a more or less separate, second, purpose has been to develop analytical tools for liner service optimization. Thereby we use different approaches.

For several years the United States has opposed the convention and acted on the assumption that the EEC countries, Japan, and other developed states would not ratify it. Now that ratification appears imminent, the United States may find itself isolated and exposed to a number of problems whose impacts may be felt not only in maritime affairs but also in trade, diplomacy, and security. This study examines the nature, provisions, and possible effects of the UNCTAD Liner Code. Dr. Juda evaluates how the regime of the code compares with the present U.S. framework for liner regulations and promotion, then outlines and assesses the major policy options available to the United States given the positions taken by the developing states and the EEC. The book is based on interviews with key officials and on U.N. and U.S. government documents.
First published in 1986, this work reports the results of the Leverhulme project on multinationals and intermediate product trade based at the University of Reading during the academic year 1982/3. Chapter 1 summaries the main results of this project. Part I focuses upon the theoretical component of world trade, dealing with both the theories of division of labour and vertical integration. Part II presents a number of specially-commissioned case studies relating to the project, concerning the motor industry, the bearing industry, the synthetic fibre industry, the tin industry, the copper industry, the banana industry and the shipping industry.
This new work by Neil W. Chamberlain will be of great importance to the business community -- and to all those charged with defining the role large corporations play in the affairs of society. Social Strategy and Corporate Structure is an objective, indepth examination of the organizational requirements of a social role for large-scale business. The role Neil Chamberlain presents is one of heroic dimensions: the political choice of goals, the strategic allocation of resources, and the tactical operations of the mechanisms of production. While there has been much discussion of corporate social responsibility, few have investigated the ways its structure will have to change if the corporation is to pursue a strategy that is both economic and social. This timely book integrates a large number of issues involving corporate activities and governance that go directly to the heart of this problem. In step-by-step detail, Chamberlain analyzes the organizational imperatives of this new age of social responsibility: the composition and functions of boards of directors and the relation of their duties to a broad system of national planning; the internal social audit; changes in the characteristics of corporate social planning; and proposals for restructuring ultimate corporate authority, either through public or outside directors. In addition, he examines the potential relevance of federal chartering of corporations, and the effects of international economic interdependence on the development of a new corporate social strategy. This book is not a detailed blueprint for change. Rather, it presents a thorough, systematic study of available courses of action for improvement, based on the principle that conventional notions of corporate independence will have to be modified for any social strategy to work. And while not everyone will agree with Neil Chamberlain, few can afford to ignore his provocative insights into what corporations must do to function effectively in a changed social environment.
When Murat Sertel asked us whether we would be interested in organizing a special issue of the Review of Economic Design on the formation of networks and groups, we were happy to accept because of the growing research on this important topic. We were also pleasantly surprised at the response to our request for submissions to the special issue, receiving a much larger number of sub missions than we had anticipated. In the end we were able to put together two special issues of insightful papers on this topic. Given the growing interest in this topic, we also decided (with encouragement from Murat) to combine the special issues in the form of a book for wider dissemination. However, once we had decided to edit the book, it was natural to move beyond the special issue to include at least some of the papers that have been influential in the literature on the formation of networks. These papers were published in other journals, and we are very grateful to the authors as well as the journals for permission to include these papers in the book.
