In Licensing Parents, Michael McFall argues that political structures, economics, education, racism, and sexism are secondary in importance to the inequality caused by families, and that the family plays the primary role in a child's acquisition of a sense of justice. He demonstrates that examination of the family is necessary in political philosophy and that informal structures (families) and considerations (character formation) must be taken seriously. McFall advocates a threshold that should be accepted by all political philosophers: children should not be severely abused or neglected because child maltreatment often causes deep and irreparable individual and societal harm. The implications of this threshold are revolutionary, but this is not recognized fully because no philosophical book has systematically considered the ethical or political ramifications of child maltreatment. By exposing a tension between the rights of children and adults, McFall reveals pervasive ageism; parental rights usually trump children's rights, and this is often justified because children are not fully autonomous. Yet parental rights should not always trump children's rights. Ethics and political philosophy are not only about rights, but also about duties_especially when considering potential parents who are unable or unwilling to provide minimally decent nurturance. While contemporary political philosophy focuses on adult rights, McFall examines systems whereby the interests and rights of children and parents are better balanced. This entails exploring when parental rights are defeasible and defending the ethics of licensing parents, whereby some people are precluded from rearing children. He argues that, if a sense of justice is largely developed in childhood, parents directly influence the character of future generations of adults in political society. A completely stable and well-ordered society needs stable and psychologically healthy citizens in addition to just laws, and McFall demonstrates how parental love and healthy families can help achieve this.

S. Matthew Liao argues here that children have a right to be loved. To do so he investigates questions such as whether children are rightholders; what grounds a child's right to beloved; whether love is an appropriate object of a right; and other philosophical and practical issues. His proposal is that all human beings have rights to the fundamental conditions for pursuing a good life; therefore, as human beings, children have human rights to the fundamental conditions for pursuing a good life. Since being loved is one of those fundamental conditions, children thus have a right to be loved. Liao shows that this claim need not be merely empty rhetoric, and that the arguments for this right can hang together as a coherent whole. This is the first book to make a sustained philosophical case for the right of children to be loved. It makes a unique contribution to the fast-growing literature on family ethics, in particular, on children's rights and parental rights and responsibilities, and to the emerging field of the philosophy of human rights.
This volume contributes to the growing literature on the morality of procreation and parenting. About half of the chapters take up questions about the morality of bringing children into existence. They discuss the following questions: Is it wrong to create human life? Is there a connection between the problem of evil and the morality of procreation? Could there be a duty to procreate? How do the environmental harms imposed by procreation affect its moral status? Given these costs, is the value of establishing genetic ties ever significant enough to render procreation morally permissible? And how should government respond to peoples' motives for procreating? The other half of the volume considers moral and political questions about adoption and parenting. One chapter considers whether the choice to become a parent can be rational. The two following chapters take up the regulation of adoption, focusing on whether the special burdens placed on adoptive parents, as compared to biological parents, can be morally justified. The book concludes by considering how we should conceive of adequacy standards in parenting and what resources we owe to children. This collection builds on existing literature by advancing new arguments and novel perspectives on existing debates. It also raises new issues deserving of our attention. As a whole it is sure to generate further philosophical debate on pressing and rich questions surrounding the bearing and rearing of children.
Children’s Rights and Moral Parenting offers systematic treatment of a variety of issues involving the intersection of the rights of children and the moral responsibility of parents. Mark C. Vopat offers a theory of the relationship between children, parents, and the state that can be applied to the real life decisions that parents are often in the position to make on behalf of their children. In many instances, our current view of parental "rights" has granted parents far more discretion than is morally warranted. Vopat arrives at this conclusion by carefully considering the unique status children have; socially, legally, and morally in most western societies. Children's Rights and Moral Parenting is essentially contractualist in the Rawlsian tradition. While it may appear counterintuitive to speak of children in terms of the social contract tradition, there is much this approach can do to provide some conceptual clarity to the nature of the relationship between children, parents and the state. The overarching theme of the book is the moral independence of children from extreme forms of parental and, at times, social control. The objective of the book is to provide an argument for extending the range of things owed to children, as well as making the case for fully including children in the moral community.
